    Cats are considered wild by law and cannot be controlled by a human.This means if they foul your garden it's up to you to find deterrents. (Look at the green fingered moneysaving board for ideas.)

    Dogs on the other hand are not - so the owner is at fault for their behaviour. There is nothing stopping anyone who finds a stray dog from calling the dog warden.
    I'm not cynical I'm realistic :p

  • having been through this too th easiest solution is to contact your local dog warden via the council and they will then go out and speak to your neighbour keeping you annon. it is an offence not to have a dog on a lead on the public highway

    Must a dog be kept on a lead whilst on a Right of Way?

    The law does not rule that a dog be kept on a lead whilst accompanied on a Public Right of Way. However, it does state that they must be kept under close control

    It may be the Dogs Act 1871 which is being referred to. If a dog "is dangerous and not under proper control" the court can make an order that the dog be kept under proper control.

    This requires more than simply being off the lead, but not being on the lead is good evidence that it was not under proper control if it is also dangerous.

    Alternatively, perhaps it's local bye-laws which are in issue?

  • See if you can get a picture of it fouling the public highway - then send the picture to the council with the owner's name and address.

  • If after one 'warning' the fouling happened again, then the stupid owners WOULD get it back through their letterbox.
    I did this once years ago and it worked.

    Not sure whether this is the best place but thought someone might have some advice!
    A new neighbour has recently moved in a couple of doors down and are letting their dog run round without a lead whilst not being supervised. We've had to move poo off our front lawn, which isn't pleasant and are also wary as we have a toddler.
    We've had a word with them and they were quite responsive but still seem to be letting him out. We don't want to fall out with them but want to keep our life as pleasant as possible!


    I have a neigbour, got a bit Staff. Over 2 years just barked, bored, whilst it got bigger and bigger. I live with communial gardens, for a nearon a year she just tied it up to the nearest tree and let it bark and crap all over the place.

    She's just had a baby too and though I should be concerned as she has toddlers too and this dog, although lovely, has bitten other dogs I worry.

    If you don't nip this in the bud now, or get landlords, EO involved - things won't change.

    Be strong, remember you've a right to enjoy your property but bear in mind some people don't do these things, on purpose just to annoy you. They actually think & live like that and have no consideration for neither the dogs nor thier neighbours.
