Yes, indeed unsecured debts do pass with the person, however there have been issues where people have paid for the debt after the person has passed away. The estate is not always liable, but these issues can be complex and lengthy. In your situation with no assests then it makes it very straightforward.

As others have said the executors are 'responsible' for clearing up the estates affairs, but all unsecured lending comes a little down the list and if there is no money left then they must be told this. They may require proof of this but that is something you might need an acountant or legal advisor to sort out on your behalf.

But you brother must stop making payments straight away! Good luck it will take some time and can be very painful as some card companies are not very helpful, but most are.

Sorry about your loss, you should inform the card company and send them a copy of your mothers death certificate, they will probably send you a form to fill out with details of your mothers estate...no estate no debt and they will write it off, they did that after my husband died.
