Philips portable DVD player has scratched DVDs

Hi everyone I am just looking for some advice and I hope you can help.
I purchased a Philips portable DVD player as a Christmas present for my daughter. We have found that it has left scratch marks all the way around two of her DVDs (also Christmas presents) and they will no not play in any DVD player in the house. After spending over 30 minutes calling different Philips customer care numbers I found I was told the same thing. They say I need to return the product to the store form which I bought it and they have to replace the player itself as well as the DVDs.
I tried to explain that I felt the shop where I bought it from would not replace the damage as it is not their responsibility and that they would just refer me back to Philips but Philips said it was not heir responsibility to replace the damaged DVDs.
I guess what I really want to know is am I being unreasonable? I have no problem taking the player back for a refund (preferably as I am the kind of person who is once bitten twice shy wen it comes to brands that do things like this) but am I being greedy to expect Philips to replace the damaged DVDs?
Many thanks in advance.

Ah ok. I was under the impression that as it is a Philips product Argos would just refer me back to them to replace the damaged DVDs. What should I say if Argois do try to say this to me?
Thanks for the reply.0 -

Sorry for replying again. I have called Argos who say it is not their responsibility to replace the damaged DVDs. They say that although I bought the player from them they are just selling someone else's product and that it is Philips responsibility to replace the damaged DVDs.
Agin sorry for dragging this out but I just want to make sure I hav all the right information before I write a letter to Philips.0 -
The retailer's not liable for consequential loss from faulty goods. But, you would think that it would be good service for Argos to replace the DVDs for you.Squirrel! If I tell you who I work for, I'm not allowed to help you. If I don't say, then I can help you with questions and fixing products. Regardless, there's still no secret EU law.

Yes they are. (A traders guide: the law relating to the supply of goods and services page 16).0
