    Welcome to the wonderful world of Debt Collectors. I'm afraid that as wrong as this is, what you have just encountered is pretty standard for the breed. In my personal experience the behaviour you were subject to was not only common but a pretty neat round up of general DCA tactics.

    Perhaps there is something that can be done, someone that can be complained to or so on, but the biggest thing I ever learned was to never, ever speak to them on the phone again. Every communication needs to be in writing. In this way they have done me a favour, even if it really didn't feel like it when I was crying into my jumper sleeves all those years ago.
    I refuse to be afraid of the big bad wolf, spiders, or debt collection agencies; one of them's not real and the other two are powerless without my fear.
    (Ok, one of them is powerless, spiders can be nasty.)


    As of the last count I have cleared

    I too received a letter from Roxburghe regarding an unpaid parking ticket dating back to May. the date and time in question I was in work and my car was parked in my employers car park. This is an utter scam, I have reported them to the Trading Standards people, the DVLA, I will be reporting it to the police later, to my local council and my solicitor one thing I wont be doing is paying them. Its outrageous that they can get away with this evil scam.
  • I have received a demand from Roxburghe for an unpaid parking fine. They state in their letter that under common law doctrine of the law of agency "..a principle (registered keeper) is liable for the acts of its agent (the driver). This is obviously in conflict with Martin's page below. Are they just trying to pull a fast one?

    If you own the car but weren't driving
    Unlike official parking tickets, when on private land, it is the DRIVER, not the owner, who is liable, because a contract to park is formed between the landowner and the driver.

    I received a letter on the 02/10/10 from Roxburghe Debt Collectors on behalf of CMS UK LTD stating i owed £170 for parking on a local retail park on the16/03/10 i park regularly on this car park there is no fee charge to park there , this is the first i have heard about it, i have never received a parking ticket ,and today i received a notice of intended legal action stating i owed £207.25 . Is this legal what do i do next its very worrying.
    Any help will be gratefully accepted:(

    Do not be worried, a private parking notice (i.e. not one issued by council orpolice) is simply and invoice to pay. No court action will be taken - DO NOT PAY.

    Have a look at the motoring and parking fines forum - you may find a letter that looks just like the one you received.

    I was driving a hire car at the time and the hire car company has sent Roxburghe debt collectors evidence that I was driving the car on that night. The address where they have sent the letter is my mum's address and I don't want baliffs going round and hassling her. I've read that this company is a scam, will they send baliffs if I don't pay the £197.00 (I am a full time student and cannot aford this amount of money!)

    Bailiffs won't be turning up at her address - she's not the 'debtor'.

    Therefore, she has nothing to do with the matter, and has absolutely no obligation or duty to deal with or even speak to them.

    Roxburghe are well known for their 'private parking fines' scamming - you'll find a lot of advice and help on this site, and other sites as well, to get around this problem.
  • I recieved threatening calls from Roxburge Debt Collectors saying that i owed them over a thousand pounds in relation to a credit card. As i had only ever had one credit card in my life and i asked them if the debt was in relation to that particular card which they said it was i eventually backed down and due to being scared of them sending the bayliffs in which was what they were telling me they were going to do i paid the debt even tho the amount seemed too high to me.

    I have just found out that the debt on this one particular card was bought by another company who can confirm all the right details and who gave me the real amount i owed which by the way is over 6 hundred pound less.

    I then contacted roxburge who are now telling me the debt was for a barclay card i have never even had!!! They told me it was all on my credit report which i did and guess what there is nothing there.

    I am also being told that because i took RESPONSIBILITY for the debt that i agreed it was mine so i have no chance of getting my money back.

    How did this company get my details?? How can they do this???

    I have still got to pay the other bill and am devestated by the whole thing!!!!

    Have this comapny done this to anyone else!!!!

    All advice welcomed please.

    Set out in writing to them what has happened. Ask for £XXX to be paid back to you.

    End your letter with 'Unless I receive payment in full within 14 days of receipt of this letter I will take County Court action against you.'

    Send it recorded and keep a copy.

    You won't necessarily have to take court action, and the Financial Ombudsman may be able to help (but only before the court stage) - see how Rox respond.
