as you were going to leave anyway I suggest you just leave on your terms and in a friendly fashion - don't make a fuss or your deposit might prove elusive. i suspect you may already have put his back right up threatening court orders

if you were going to leave anyway why did you want to start that sort of fight?
I think I saw you in an ice cream parlour
Drinking milk shakes, cold and long
Smiling and waving and looking so fine
  • Is it the end of a fixed term AST and the landlord is giving his statutory 2 months notice to reclaim the property, or have you done something to warrant eviction as this could pose problems in getting another private let?

Yes it's the end of a minimum term AST. I haven't done anything that could pose problems getting another private let. I'm a good tenant, I pay my rent on time every time and keep better care of the property than the other tenants. When you say this, do you mean that if landlords are members of the national landlord association then they could make a complaint about tenants to warn other NLA members?

Except tell the landlord he will have to evict you through the courts? Do you want a bad reference and/ or legal costs lodged against you??

there is no such thing as a national blacklist of tenants... but.... local landlords and agents always keep each other informed of poor payers/scammers/cheats and thieves....

But why are you trying to be difficult in telling him he needs a court order to get you out? It is the end of your contract and he is well within his rights not to renew the contract. As Clutton says word will get around local landlords if you deliberately try and be difficult. If you have been a good tenant up until now then why don't you just find somewhere else? Then your current landlord can give a good reference to your next one

    Sooooo...

I've been served with a section 21 kicking me out in 2 months. Landlord delivered it in person and I explained that he couldn't legally evict me from the property without obtaining a court order...I hope that's correct

Anyway, good thing is that I was planning to hand in my month's notice in the next few days....so it seems it doesn't matter.

Sigh, how sad must I be to be turning to MSE on the day I get evicted. I secretely wish I hadn't already planned to leave so I could make them get a court order and make it as difficult as possible for them to get rid of me (they haven't been nice landlords at all)

    :(

They're probably kicking you out as you sound like an a$$ - you were planning on leaving yet start making noises about the landlord needing a court order. It's tenants like you that gives everyone a bad name and makes me agree with landlords that there are too many protective steps for tenants. I mean the guy has given you a couple of months notice, why shouldn't he get his property back.

You haven't been evicted. You had a AST, which the landlord has chosen not to renew. That was his choice. Either you have not been the wonderful tenant that you think you are, or perhaps your landlords circumstances have changed. You don't know and TBH, it doesn't matter. By threatening to take him to court, when you have absolutely no grounds for doing so, makes you appear vindictive, another member of the greedy 'I'll sue, I'll sue' club, or just plain stupid.

Instead of whining, why not use the time constructively to find a new home.

Edit: LL would probably be well within his rights to warn your propective future LL (in his reference) of what might happen if/when your tenancy comes to an end. If he does any LL with an ounce of sense will steer clear and you will have no-one to blame but yourself.

You sound like a nightmare tenant. Why would you want to provoke your LL by telling him that, if you had intended to move out in any event?

Have you not thought through the need to depart on good terms, in order to secure a clean reference??

Reminds me of the old trick for getting a pig into its sty - try moving it away from the sty and blocking its route.
