Phone calls from creditors

Does anyone know how many times a company can call you if you have a debt with them? I have a bank account debt with LLoydsTSB which is being paid through CCCS, I also had a loan which was being paid by protection loan agreement which came to an end on Monday of this week. Its not my biggest debt its actually one of the smallest, its less than £500, i have another debt with LTSB credit card that is for approx 4k and they have have never hassled me or even phoned me, so what is wrong with these guys? Since this loan agreement finished LLoydsTSB have phoned me everyday this week and twice on Monday, twice on Tuesday after that once a day. They phoned again this morning and the woman i spoke to said they had only phoned me once this week as all the calls were logged on her computer and they are allowed to phone up to 3 times a day, over this it is then classed as harassment, is this correct?. She also insinuated that i am a liar when i said new proposals had been sent out to them on Monday of this week by CCCS, because she hasn't received them. I have mailed a letter of compliant to them telling them to deal with me only by letter from now on or litigation may be filled against them for harassment. Am I within my rights to do this? I have also blocked their number from calling me though BT choose to refuse but they are changing numbers and getting through. I am severely disabled, not well at the moment and going through a really bad time as well and i just can't cope with this at all, it's getting to the point where i'm scared of answering the phone. Changing the number would be the easy option but its in my sons name and hes out of the country until 19 August and BT wont do anything without his say so. Any help would be really appreciated. I just can't take may more of this, the people phoning me are just so nasty on the phone, I've put the phone down on all but 2 callers as each time i could feel myself starting to cry again. TIA

The 3 calls a day is complete rubbish, if you find 1 call a day distressing then it is classed as harassment.

Try the following; Courtesy of the debthelpuk forum

    By Recorded Delivery

    Dear Sir,

    Ref. XXXXX

Despite my letters regarding ANY communication from your company, which stated that I require ALL communications in writing, your telephone calls continue.

This behaviour constitutes harassment; the letters stated quite clearly to you that I require ALL communications in writing for future Court use. Do not telephone me again - remove any telephone numbers you hold for me from your systems.

Your telephone calls are in breach of the Office of Fair Trading guidelines. If you continue with them after the receipt of this letter an official complaint, together with a log recording the times and frequency of the calls will be passed both to that office and to the Trading Standards office. For your information note that ALL telephone calls are taped.

This type of debt collection method is contrary to the ‘Administration of Justice Act 1970’ in that it is intended to cause alarm and distress to the recipient. Your methods will not be tolerated. A formal complaint, containing copies of all correspondence including yours, has now been submitted to the relevant authorities. This will be relevant to questions of your fitness to hold a licence under the Consumer Credit Act, whether or not it results in a prosecution.

Take further note that continued telephone calls after the receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.

Communicate in writing and ONLY in writing, your telephone calls will NOT be answered.

HOWEVER, CALLS WILL TRIGGER COMPLAINTS TO THE REGULATORY BODIES.

I trust that I have made myself understood on this matter,

    Yours faithfully,

 It’s hard enough remembering my opinions - without remembering my reasons for them

A positive attitude may not solve all your problems, but it will annoy enough people to make it worth the effort

My advice is change the phone number and don't give it out to anyone other than friends and family. Give the creditors a mobile phone number if you have one. They don't tend to like phoning as it cost them more, if they do phone the mobile switch it of.:D

Lloyds have got really nasty recently. I owe them a huge amount of money - 2 loans, 2 overdrafts and a credit card. As soon as I began to struggle they began to ignore my letters and phone calls asking for advice. I have been on a DMP with Payplan for several months- and Lloyds get the biggest pro rata share. Recently they have begun to harass me to take out another loan to wrap up the 2 loans and 1 of the overdrafts. I declined - another loan is the last thing I need and anyway the DMP stipulates that you shouldn't take out any more credit. They have written twice and phone at least once a day - I now just put the phone down on them.

Sorry just reread post the phone line is in someone elses name, then its not yours and they have no right to block his phone line.

Really easy. When someone calls they will say "Can I speak to firstname, surname" If you hear that you know it's a debt collector. Say I'm sorry, i think you've got the wrong number.

They'll give up after two attempts and start the letters again. That way anyone who knows you will as for you by first name. You'll know to say "hi" then rather than feeling your way around who is calling.

Also helps get rid of telecanvassers.

Whatever you do don't feel as though you have to speak with any of them. You don't. I had a spate of telecanvassers doing my nut in when we changed numbers and they called me every night after 7 asking for Mrs Smith.

I'd just pick up the phone and say "Yep, I'll just go get her." then I would leave the phone in the bedroom, still on the call with the door shut. Half an hour later I would go hang up.

Or when they try and do the Data protection thing with you say "I'm sorry that's classified information" or ask them back for their inside leg measurement and if they are married and what colour shirt they are wearing. Have some fun with them! They normally hang up pretty quickly

Im still waiting for Cahoot to come back as to why that distributed my email address without permission. I have asked for an audit trail around my data and can prove that this email address is for sole use of cahoot.

They sold it to another creditor whoa re trying to sell me a loan.

I have also asked that creditor where they got details from.

Ooooh nice! I'd be interested to know how that goes. I'm sick of companies apparently flogging my details on when I always tick the box saying "no" to data sharing in any shape or form

I think this might be against the banking code or the OFT debt collection guidance. One of the two says it is wrong to pressure someone in financial difficulty with another loan to "fix" it
