Robbed by Tesco Loan Insurance

I was made redundant mid october 09, due to my employer entering into an IVA and the firm ceasing trading. I was only given 24 hours notice and understand that I will have to claim Notice pay, wages ,holiday pay & Redundancy from the goverment. To date his IVA:( has still not been accepted by his creditors.
I claimed on my Tesco Loan insurance and all seemed to be going ok, until I received a call from Tesco, to say that I wouldn't be due any insurance monies until March 1st 2010. This was due to the fact that after 13 years service with my former employer, I would be entitled to 13 weeks notice pay. The rude Tesco lady, told me that it was quite clear in the policy document, that they don't pay insurance on any Notice period. I was baffled because most of my colleagues are entitled to Notice pay, but none of them, have had payment protection denied them, on that basis.
I have been offered a job in the New Year, so the upshot is that after paying this insurance(the loan is fully paid in July 2010)for 5 years, at the time of most need, I didn't receive a penny in benefit!
Needless to say, i will be going into battle, once Christmas is out the way, to claim Mis-selling. I have downloaded the templete letters and will follow the process through.
I just wondered, AM I THE UNLUCKIEST PERSON or has anybody else had this trouble with Tesco?
I have made a complaint by telephone and the nice lady who I spoke to from Tesco Personal Finance, was adamant that I had been treated badly. She encouraged me to complain, as she said, loan insurance was not dealt with by Tesco anymore, but a seperate firm. She was astounded when I told her that I wouldn't be paid out on my claim until March 2010. That would mean an exclusion period of nearly 5 months!!!
As far as I can tell, this is unheard of, on most policies. Are these people lying to avoid payout???
I have the original policy document and I cannot see any exclusion regarding Notice payment.
As a final insult, the information given to me about Notice entitlement is simply wrong. I was told by Tesco Ins, that they had calculated, that I was due 13 1/2 weeks Notice, but even I know, that the total is capped at twelve weeks!!!!
WRONG, WRONG WRONG!!!!
I will post the result from my complaint, in due course......

I would just get the complaint in for misselling then now. If its not in your loan contract as to the not paying for the notice period then they are wrong to state it. I take it you have read the reclaim guide and got your letters ready. You send them by recorded delivery and give the firm 8 weeks for a full and final response. You should be OK to use the FOS (if they do not play ball) too if the loan was for 5 years and ends in July 2010 as all sales of insurance were regulated since 14th Jan 2005.
Good luck with this one. If you need any more help then just shout away and as regards others having problems with tesco personal finance I can state being a regular on here that lots have and WON...0
