  • Tell the insurance company ASP. My experience is that he will be sent a form to complete with his evidence with diagrams.
    The police are very experienced and are informed by the scene at the location of the incidence.

    The decision to prosecute isn't down to you, but will be decided by the Police/CPS/PF depending on where in the country you are. The accident gets reported to the insurance, and they will decide how to go about getting a replacement/repair organised. The info given by your son, and any prosecutions brought as above, will help determine blame. In any case, you will have to pay your excess before the repair/replacement is done, which will then be refunded from the other person's insurance company if blame is attributed to them.

    In all fairness, a witness would have been helpful, but photos should have been a priority for you son after the accident (not always easy when your head is up your bum in the aftermath). As long as everyone is uninjured, that is the main thing. Cars can be fixed/replaced. Bodies are a bit harder to get sorted out.
