PS3 Not Reading Disc's - Sale of Goods Act?

Quick question really to find out if I'm wasting my time and barking up the wrong tree.

I purchased a PS3 in October 07 and on Christmas Eve it stopped reading all disks. So rang support up and went through some steps and they left me with some more to try because they didn't work. Finally got through the last of the steps and phoned Sony back today and they said it indicates a hardware fault. The cost to get it repaired is £100 which will give me either a repair or refurbishment and 3 months warrenty. Really it's half the price of a new one so am tempted to save up a little more cash and get a new one which will give me a years warrenty. Only downside is I then end up losing the Backward Compatibility, but could probably live with that.

So reading various things, since I'd really expect a PS3 to carry on functioning long after 2 years, would it be covered under the Sale of Goods Act for repair? If so would it be down to Not being Fit for Purpose or Not of Satisfactory Quality? Or would it not be covered under the SOGA at all?

  • First question: Have you tried a lens clean? A couple of dirty disks could easily leave a few marks on the lens over the course of two years that could lead to a reading error.

    Secondly, the SOGA gives little indication of what is "reasonable". Whilst a consumer will argue that Sony is a name associated with quality products, Sony themselves will likely argue that PS3's are built down to a price and sold as a loss-leader (both statements would be true - Sony make a loss on the consoles and make their cash back on games / online subscriptions). You could argue it but it would be just that - an argument.

    Then there is the fact that with SOGA you shouldnt argue with sony, but the retailer.
    Back by no demand whatsoever.

    I changed one recently, it isn't too difficult at all if you are happy with little screws and ribbon connectors. About an hours work.

    There are loads of youtube videos showing the replacement procedure.
  • 26 months - not sure how far you'll get with this. Also as you've had benefit from the item you would get a full refund if that's the option they chose. Say expected life is 4 years, as you've had over half that in use you'd get less than half the cost of a PS3 back.
  • Haven't tried a lens cleaner, will pop into town and try and pick one up tomorrow in hope that it will work, although doubtful. When inserting the disc it just doesn't seem to spin at all, ejecting the disc again it comes out in exactly the same position.

    I suppose the main question is that is it worth contacting the retailer regarding the SOGA or would I just be wasting my time with it?

    Symptoms are exactly the same as the one I fixed. No spinning of disks at all.

    People did suggest a complete reformat and restore to factory settings occasionally works for non spinning disks. It didn't in my case but I had a go anyway.

    Put the new laser in and it worked fine. Just ensure you have someone comfortable with dismantling this type of gadget
