Refund when store policy is exchange only

I bought my daughter a mobile for xmas from http://www.cex.co.uk/ on Tuesday. There store policy is exchange only no refunds.

When my daughter put her Orange sim card in the Orange phone it says "Inactive Sim". I tried other family members Orange sim cards in it says the same thing. Does this mean the phone has been blocked?

Am i entitled to a full refund on the phone or do i have to accept an exchange or credit note if i was sold a blocked phone?

  • Did the website specifically say it would be unlocked?

    If it didn't, you'll probably have a hard time getting a refund, especially with their policy.

  • I bought it from the branch of the named store not online.

    It was sold locked on Orange network.
  • The first thing I would do is check with Orange that the phone is / isn't blocked. They should be able to tell you this if you give them the IMEI number (which should be on the barcode sticker under the battery).

    If the phone is blacklisted (most likely because it has been reported as lost / stolen), then you will be entitled to claim a refund as the goods are "not fit for purpose". The store's policy in regard is irrelevant.

  • Wouldn't even bother with Orange - go into the store point out it is Orange branded, stick a sim card in, show it doesn't work and ask for your money back. If they argue (and I doubt they will) get the manager out, if still no joy comment on trading standards+police and selling stolen goods (as this is the most common reason for phones to be blocked).
