    One cannot enter the world of potential future consequential losses. The OPs costs are intrinsically linked to her moving out and thus, only those can be included in the financial negotiations.

    If the house is sold via agents the op loses 50% of the full EA costs, by accepting part of this as a reduction in her offer she is up - that is a figure that can be realised now and not some future speculative number that may or may not come into play.

    She shouldn't figure out whether this is even or fair, just how to get the best deal for herself - the reason why so many settlements like this go badly is each party doesn't want to see the other side get 'more' and in the end can end up with less after all the costs of the bickering get included.

    Hi Christmasjones,

    I was in a similar situation to you a few years ago except I was the one buying out my ex. We agreed on an amount based on the equity in the property and I appointed a solicitor to do the transfer of deeds etc. This was at my expense which was about £500 i think. (6 years ago now)
    About half way through the process he demanded more money so I told him to go and get his own solicitor and we could thrash it out through them. He soon changed his mind as the legal bills would have rocketed.
    You could try a similar route, the solicitor would be acting for you as you will have appointed them but as long as it is amicable it should be a fairly easy process. That way he gains a little bit more money as you pay the fees.
