Apple sold me wrong case, my rights?

so if i go to a shop request an item to fit X item
which the shop supplies
get home and it doesnt fit
its my fault?

Well, stupid of me really as I do remember seeing a little compatible thing in the corner but with the whole excitement of getting an ipod I didn't look closely, i just threw away the packaging (into the food bin) and didn't realise it was the wrong size until i tried to put it on later.
I'm heading into the town where the apple store is located tommorow, so I will see what they say. I noticed on the back of the receipt it says
Please note: opened software, memory, and other media can be exchanged for the same item, but cannot be returned for a refund.
I'm not sure if this would cover cases however? I would like an exchange but for the correct size.0 -
Im sorry but you lot saying the op has no rights are talking rubbish. Goods sold must be as described.
If a salesperson told you a certain mobile could do X and it couldn't, then of course you have recourse. So does the OP. The sales person knew what its purpose was, and sold them something not suitable for that purpose. Packaging will be irrelevant as the goods were miss-sold.
I would *hope* apple would spot their mistake and rectify it instantly. However the issue will OP is if they refuse, you will have no hope to prove that your nan did ask for the correct case. So yes you have rights but you may have problems proving them. Its worth a try though as long as you keep the heat on them and remain polite. The fact that you had a 5th gen at the same time will strengthen your argument.Back by no demand whatsoever.0 -

Well I do have the receipt, which shows that the ipod 5th gen and the 4th gen case were bought at the the same time, also i'm presuming it's a thing in the apple stores where the staff advise you? As they were with my parents the whole time, the sales person even brought a chip and pin machine over to them rather than them going to the check out. The sales assistant who was with my mom also told them it was his first day, so surely from the transaction code they can find out which member of staff helped my mom and see that it was easy for them to have made that mistake?0 -
Apple once told me that their stores are covered with cameras. If this is true, then maybe you could suggest they check their footage on such and such a date and they will see their sales person show the ipod then a selection of cases.
Seems a bit extreme and hopefully you wont need to take things this far but it's worth a thought if they dig their heels in.
My experience of Apple isn't good either. A sales person told me something that I later found out was completely inaccurate and was what swung the sale. I would not have bought had I been correctly informed. Apple's first tact was to deny I was told this and they immediately backed their employee, and insisted I was wrong. It took a lot of effort to make them change their stance. Not the most bending of companies imo.
Good luck. You should definitely go back and ask for the correct case but you may have to push it.Herman - MP for all!0
