DLC / Direct Legal & Collections

Bit of back round here first. 5 years ago had 50k ish of credit card debit. With MBNA (short settlement) COOP (Short Settlement) got this two dealt within 1st 6 months. Halifax / BOS (Short Settlement took a couple of years) x2. Two left One Halifax / BOS £9k and One Halifax / BOS / Sainsbury was £6k ish now over £9k as they would not freeze interest and charges etc, did on other card but not on other one! Having been paying £1-£2.00 per month, over the last year being paying £10 per month on each one. Got letter yesterday saying that the Sainsburys one had been sold to DLC / Direct Legal & Collections. They have agreed to accpet £10 per month for the next 6 months. Have not got any money to offer on settlement on these two left. I have being looking around and DLC seem to operate very near the line with their tatics.
Just currently after advice, on what to expect next. I do have a house with a mortgage on it and have read thet can get a chrage on my house is this true as the credit debit is unsecured.

    dlc are not the best to deal with, communicate via email or post only though and refuse todo over the phone as they will twist things. They can go for a charge once a ccj is issued so ensure you always keep the pa bang on.
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    DLC are a very dodgy so it is best to deal with them in writing only and send the letters by recorded deivery.

    I would also keep a copy of every letter.


    When was your credit card taken out if was before April 2007 request your Consumer credit agreement.

    This will give you breathing space because if they have not provided it after 12 working days they will have to put the account on hold and stop collection activity.

    DLC have been looking for my credit agreement for four months and they still have not found it. When they put your account on hold they will still send you a standard letter every 21 days telling you that they are still looking for the credit agreement but no payment is required until they find it.

    Providing I keep paying the £10 can they go for a ccj even if thats all I can afford?
    I have had credit card "trouble" for over 5 years, so this card was taken many years ago may be 10+ years ago.
    If I request the Consumer credit agreement for this card will this help me at all? Do I just write to them and ask for a copy of it?
    I will take on board about only writing to them via Royal Mail recorded, thanks for the tip. So far I have kept every letter over the last 5 years to all the credit credit compaines so have a hugh box of paperwork!

    Yes it is worth asking for your CCA because the account will be placed on hold while they are looking for it and you will not have to pay.

    There is a good chance that they do not have your CCA if you took your credit card out 10 years ago. DLC have not found mine yet and they are still looking for the past 4 months. The debt is not legally enforceable without a CCA for any credit taken before April 2007.

    Do I just write to them and ask for a copy of the CCA, HBOS have just sold the debit onto them who I have been dealing until they sold to them, they have enclosed a letter from them too. Would HBOS not have kept a copy of it?

    I would write to DLC because they have the debt now and it up to them to request the CCA from HBOS.

    Just been having a brief read over that thread, looks like the courts found in favour of the banks, are the banks now gonna be able to do this every time now?

    Also is it worh me writing to HBOS about the other credit card, before they sell that one?
