Incorrect Location given on PCN & Observation time Only 1 Min...Advise please

Hello,

I have received a PCN Code 35.

On the ticket it states I was parked at an address No; 19 Church Street...
I was sure I was actually parked at No; 37 Church Street.... some 80 Meters away.....
Also on my ticket the observation time was ONLY 1 Min...
I have checked & for PCN the Observation Time should be 3 Mins...

I immediately went into my council office & filled out the Challenge form & requested that I have ALL photographic evidence supporting the ticket.
The Councils Photographic evidence arrived in the post - And.... The photo clearly shows my car - as I first thought, at no 37 & not No 19 as stated on the ticket....

4- Questions....

1) Do I have to pay for this ticket due to the incorrect location -80 Meters away - I drive a little diddy Ford KA & it is certainly not that long..... ;0
And I certainly could not have been in 2 places at once....

2) Can the Council then re-issue another ticket (by Post) at a later date with amendments (or New ticket) & the Correct location?

3) Is the observation time incorrect & can that be challenged?

4) When you drive into (what is supposed to be a 'Disc Zone') Are there supposed to be signs saying "You are now entering a Disc Zone'

I have read somewhere that a ticket has to be legal to be enforceable - which I'm pretty sure that this falls in that category, but please correct me if I am wrong..

Any help & advise will be very much appreciated.

  • 1 and 3 I doubt you will have much leverage with as it would probably be classed as de minimus. 2, the council should not issue a new ticket, they have one chance to get it right and thats it, any reissue would probably negate both.
    4) I don't know anything about disc zones, hopefully someone will be along soon to help.

    check www.pepipoo.com which is a specialist website for parking tickets and disputes. They were very helpful when my son was caught speeding.

  • If your car was parked 80 metres away from where the ticket indicates then the ticket is deemed to be flawed and will go in your favour. It is in the hands of the appeals now I assume and you should win this

    I think the OP has already posted this on pepipoo. I certainly read the same situation a few days ago, either here or on pepipoo.

    Hi,

    Yes, I had posted this somewhere else as I was having trouble with this site - oops.
    I was wanting as many opinions as possible as it's X-mas & Bank holiday the Council only allow you 2 weeks either to pay or ask an adjudicator to look at it.
    I think I'll appeal, thanks for advice. Fingers crossed ;) - I'll let you know the outcome.

  • Can I suggest you rough out the appeal and run it before pepeioo first, they will fine tune it and give you a better chance of succeeding.

  • It's very difficult for people to give adequate advice when there's no paperwork or photographs to look at.
  • What I meant was, go to the thread you have on Pepipoo and post there what you are going to say to the council and let them have a look at it first. They know the way councils work and think and will suggest different or better ways of approaching it. I suggest that at the end you append photographs or scans of both sides of the documentation you have received after first removing your name/address and vehicle registration number plus any picture you have either from the council or your own. The information they will give you will greatly increase your chance of success.
