Getting Credit Card company involved in refund-How???

Hi,

please move this if it's not in relevant forum!

I've bought a TV from an electrical shop (no names just yet!) and am having a battle getting them to exchange the faulty item. I don't really want a refund, just an exchange as I like the model of TV, but if it comes to that I'll take it.

However, I've read on this forum about getting a refund for an item from the credit card company - I bought this £1000 TV with my credit card.

How do I do this? do I just phone up my credit card company and ask for a refund????

    You will need to speak to the relevant department in your card company (normally called something like disputed payments) and they will ask for a copy of all correspondence with the company and a covering letter explaining the problem.

    As you still have the item I doubt they will get involved - they will probably say to speak to the company again. Have you spoken to Trading Standards about it?

    No letters etc have been written yet - I'm just jumping the gun and arming myself with information, just in case things do start to get nasty/difficult!

    Assuming the set is more than a few days old then the company will have the right to check for and effect a repair within a reasonable time scale. The key facts fro the sale of goods act are here.

  • I've had good experience of a refund through barclaycard.

    Had theatre tickets booked through ticketmaster for 8th of july in london last year, we all know what happened on the 7th. The ticketmaster website said at the time that the show was still on but would refund anyone who did not go. We decided not to go and we would get tickets for a later date. To cut a long story short, ticketmaster wouldn't let us reschedule or give a refund.. They refused to discuss over the phone so had to communicate by email and they took two weeks at best to respond to every email. After two months of getting nowhere with TM, one call to barclaycard and they provisionally credited my account and they fully credited it when they recived all of the communication I'd had with TM and a screengrab of thier website saying I'd be able to get a refund or rescheduled tickets!

    Also may dad has had a refund actioned through barclaycard for a disputed ebay purchase.

    Not sure if other credit card companys are as effective in this department as barclaycard,

    if the goods are faulty you can reject them
    although certain stores - like comet tell you your wrong and cant

    trading standards were good and sent us letters to send to the MD which got the probelm sorted

    I did have a probelm with Barclay card as they didnt want to get involved, lost all the documents we sent them and delayed the whole matter by almost 3 months.

    by law you can reject the goods as they are faulty and are entitled to a full refund.
    Be firm and state its faulty - do not waver and threaten leagal action through the county court and say you will report the whol matter on this site - they hate this.

    they may tell you TS are wrong - again be persistant
    you will win if you do this

    Thanks for the answers - the matter has been resolved!
    Engineer came to look at faulty TV & declared the TV "!!!!!!ed" (his words!!).
    One phone call to the store from the engineer later and I was able to exchange the faulty TV - the new one works a treat.

    I am amazed at how well Comet handled this - especially in view of all the complaints I've read about them!
