Nursery charging for money already paid!

Hi can someone help me?
My previous nursery went into liquidation and opened up same company in new name without informing me. I paid all my nursery fees by way of childcare vouchers at the start of the month 5 days before went into liquidation.
The nursery are now taking me to court to recover money in the new name and have dissregarded all money paid to liquidated company. Once i found out they had gone into liquidation i removed my child immediately as all trust had gone so the nursery are also trying to recover 4 weeks notice as stated in my terms and conditions of liquidated company.
Surely a court would not rule in her favour???

    I would doubt they can have it both ways.

    I suspect you are stuffed as far as vouchers are concerened will need to write to the administrator etc.

    But did you sign a new contract? I suspect not and if that is the case then you have no contract with them.

    So same people running it? I would not be happy if it was me and would look at talking to other parents etc.

    Ah, the old Phoenix company trick. One company goes under and is resurrected under a different name - ie the old company might have been called Phoenix Nursery Ltd and the new company called Phoenix Nursery No.1 Ltd. So you paid your vouchers to the first company and are now a creditor. The second company has taken over the contracts for supplying nursery services and invoiced you. In doing so they have provided a service and not taken on the liabilities of the old company.

    Technically you do owe money. I imagine there's something in the original contract that allows the contract to be "traded" or assigned.

    Morally it stinks big time.
