PLEASE READ as this is about to happen.
Before I start, I would like to point out that I am fully aware of OFT and Supreme Court rulings. I have also assisted friends in the past to claim back thousands of pounds of unfair bank charges from various banks. So image how frustrated I am now feeling knowing I could find myself in the same predicament.
I’m in the fortunate position of being debit free, own my own assets, how no credit cards owing and no overdrafts. However 10 months ago I was made redundant and received a year’s salary, which I had paid in a number of accounts. My main account for paying direct debits was Nationwide which I have serviced by paying sufficient funds from other accounts to make sure all DD’s are met. These transfers normally took same day to complete, in this case HSBC to Nationwide. However a recent transfer took 5 days to complete arriving the day after all my DD were due causing 6 DD defaults. On receipt of a statement from Nationwide saying they will levy 6 x £30 = £180 on my account on the 26th Dec, I contacted them to protest and try and resolve the issue.
Despite speaking to various people, I was given absolutely no compromise to the situation and was told they had the right to do this and I should had made sufficient funds available, blah blah blah. When I referred to unfair charges, I received a monolog reply relating to the recent Supreme Court ruling like some perverted person implying “HA HA you cannot touch use now”. It seems their whole attitude had changed from the experience I had previously had when assisting friends
So here is my dilemma, I have stopped all future DD on this account. It is £114 in credit and they intend to levy £180 bank charges on it, taking it overdrawn. They have offered me a temp overdraft facility because it will go overdrawn if I don't transfer sufficient fund to cover the charges. I have said no I don’t want one and I want to close my account. They have refused saying they cannot are there are charges still to be applied.
If I pay the £180 they have won and once again made money without regard to the situation and my account history since 1992.
If I do not pay the difference it will go over and I will be charged for additional unauthorised overdraft and no doubt be applied further charges, whilst having £114 stolen from me.
In my opinion this is nothing more than legalised theft, now endorsed by the Supreme Court who have ignored or previous rulings and given the banks licence to do whatever they want until there is another ruling or the government steps ins.
Please advise on my next move.

If this was the first charge in a year then ussually it would be refunded.
I would wait until the OFT announcement tomorow before deciding what to do next.0 -
I wouldn't give them the chance to add additional charges that you might not get back by not putting enough money in the account to pay what they want, but don't give up arguing with them!0
