congestion charge late issue of pcn

Hi
I have received a PCN for non payment of TFL congestion charge on 12th Nov 2009. The charge notice is dated 17th Dec 2009.
Does anyone know if the 14 day rule applies as it does to other motoring offences.
Any information would be greatly appreciated.

  • As far as I know there's no way out of paying unless you were forced into the zone by roadworks etc. If in doubt see what others say on here and pepipoo.com.

    As far as I know it has to be dated within 28 days. Although, they could tell you they had to get your details from DVLA in which case they will have more time.

    I'm not sure why they would need more time to get Registered Keeper details? Although I do not know for sure most (all?) Civil Enforcement Authorities will have a direct and immediate access to the DVLA Database.

    If you've just bought the car and the details hadn't been changed over yet, or details recently updated, the previous keeper may have informed them. They will then have more than their standard time limit.

    This just happened to me too, forgot to pay on the 4th Dec, PCN letter dated 17th Jan arrived today (18th Jan).

    Have acess to a legal advice helpline and called them for some advice. Sadly it seems that for the Penalty Charge Notice (PCN) there is no formal time limit by which they must send this to you.

    If you do not pay this (the PCN) then the second step in the process of escalation is the "Notice to Owner" (N.O.). This N.O. must be sent out within 6 MONTHS from the date of the offence, if this isn't done then my understanding is that you're off the hook, however I think the odds of them not sending this out when they have 1/2 a yr to do so is pretty low.

    I'll be paying my reduced fine now :(
