    Im sorry, but we have done this exact thing ourselves and the court placed the case in the sellers area some 70 miles away.

    The case can be started in any county court.
    The court will then transfer the case automatically to the defendant’s nearest county court if:
    • the case is defended, and
    • the claim is for a fixed amount, and
    • the defendant is an individual, not a company.
  • This is just and idle threat in my opinion.

    If they tried, they can only sue you for the difference, taht may only be £100 so not really worth all the effort.

    Contact ebay, and advise them of the reasons for cancelling the auction.

    Can you still sell? if so, i suggest you try, even if you ask the seller for some more money. if he think he can sell for £2k more then let him offer you more money

    I wouldn't be so quick to assume. It's incredibly easy to make a small claim in a county court and would certainly cost less than £100.

    If the prospective buyer has a casual interest in the law, they might consider it a fun way to test the legal process and get a better idea of how it all works.

    £5000 At least it was a few years back so may be more now.

    I thought it was £5000 for a small claim....

    Update:
    Assuming that the web page at CourtroomAdvice.co.uk is correct...:

    "The Money Claim Online system enables you to make claims of up to £100,000. Claims of over £15,000 can be heard at the high court and claims in the small claims court can be up to £5,000. The County Court can hear claims of any amount with no upper limit."

    It is up to £5k - unfortunately in small claims court even if you win you are unable to reclaim your own costs. You then have to try to get settlement of the judgment. So on top of the cost of bringing the case, your travel costs, lost income as you will have to take a day off work .................

    Why didn't you cancel the listing before it ended if you knew you couldn't sell it.
    How was the buyer suppose to get the item if he stays 70miles was he going to come collect etc.
