Hi,
I know this doesnt entirely link to this forum but I really need some help. Is it legal for a company to take a direct debit for an invoice which you have actually disputed?
I had an invoice which I have queried and said i was not willing to pay and the company have just taken the money from my bank anyway!!!!:mad:

If the company has provided you with the correct advance notice of the amount to be collected, then you shouldn't be claiming a refund via your bank under the DD guarantee unless you should have asked for the DD not to be collected in advance.
I'm not sure about the legalities of making a fraudulent claim to your bank, but the bank will take your word for it. I'm not sure what recourse the Originator may have for such a fraudulent claim (but they probably won't bother anyway)
Be aware that even if you decide to get your money back from your bank, that doesn't mean you don't owe the Originator anything; the bank are not a dispute resolution service."Now to trolling as a concept. ....
