Q_Graphic.gif Does the hardship rule still apply? Can I still claim if I'm in hardship?
    A. The FSA's hold on banks dealing with the reclaim has been lifted, so there is no longer a specific hardship rule. ...

The bank still has to look into your case under BCOBS which is about treating customer in financial hardship fairly and furthermore under the lending code section 9.
As Premier has stated with the link, after the SC decision the FSA Waiver was withdrawn but the same principles still apply through BCOBS and the lending code.
I have not worked for NatWest Bank since February 2009
