    Soolin thats good news.

Bear in mind if you had been with a normal Insurer they would have replaced the car with a brand new equivalent if it is written off in the first year of ownership from new (Normally stipulates you are the first registered keeper)

As a named driver on my mothers policy a was stationery in my vehicle when it was hit from behind by another, i telephoned our insurance company Auto Direct who recommended that I went with Albany Assistance and would not have to pay my excess if I excepted this offer which at the time was good as it was £300 a didnt have and the other driver had admitted liability at the scene of the accident. I recieved a card through the post about 6 days later from the other insurance company who admitted liability for the accident and offered to do repairs and give me hire car and apology which I had to sign for at the door as recorded delivery, this was back in may 09 and as far as a can remember I telephoned auto direct or Albany Assistance unsure who and declared this, I was told by the person on the phone that because I claimed my insurance I was not allowed to deal with the other side and to send the card to them which I did, I now april 11 have received solicitors letter saying that my insurance company knew nothing about this card and Albany are charging other insurers to much for hire car and feel a have been stitched up to say the least please help what are my rights on this thanks Kenny.

The only reason Albany Assistance don't want you dealing with the third parties insurer is because they will lose out on excessive hire charges.

Are you in a hire car at the moment from Albany Assistance?

If so, ring the other parties insurer (as per the card you received) and explain you have entered into Credit Hire but you would like to deal with them instead. They will liase with Albany Assistance to cancel the credit hire and move you into a hire car supplied by them. The third party insurer will cover these costs (I was a previous outbound handler funnily enough for admiral doing the same job as the third party insurer are doing).

Albany Assistance are useless, will probably end up repairing your car badly and just draw out the entire process to get more money. If I ever had a non fault accident I'd approach the fault parties insurer and get them to deal with it, they'll be far more willing to deal with things to get it out of the way.

I think evan Albany would have repaired a car from May 2009 by now
  • The other insurers have settled up with damage caused to our car they are refuseing to pay the hire car issued by Albany Assistance because charges are to high and they offered me a replacement vehicle but my insurers told me that I couldnt deal with the other side, I have now been cited for court du to this dispute and because my mother signed some hire car agreement with Albany she fears we will be liable for the cost of hire car, my insurers auto direct or Albany are lying I declared this offer from other insurers and sent it to them per there instructions so a have no evidence on this and a feel the lawyers are making me out to be a liar very frustrating have already had several conversations with auto direct appalled they are fighting over couple of hundred pounds.
