fake goods

brought a gucci bag from ebay but is clearly a fake. Opened dispute but seller would not refund. Had email from ebay requesting that i produce documentation to prove that the bag is fake. The bag as not got a serial number and the quality of the bag is very poor. Surely the seller should be the one who has to produce proof that the bag is genuine. If ebay do not hear from me they would close the case i think this is unfair as i will be landed with a fake bag. I always thought ebay protected the buyer but this is clearly not the case. How can i prove the bag is fake, i doubt whether a department store that sells gucci would give me a letter stating that the bag is a fake. Any help would be appreciated.

    take a picture of the bag from various angles and email it to a gucci retailer and ask for their comment,
    in the meantime send the seller an email stating thatunless they refund you will pass their details and the bag to gucci for them to make a prosecution

    You'll be lucky to get an authentication from Gucci - pop over to thepurseforum.com and ask the girls advice there on how to get one (if they do them at all).

    Also name and shame the seller on here, and make sure to leave neg feedback.

    how much did you pay for the bag? and does the seller have any others for sale?

    You might want to tell your local Trading Standards too - although they won't do a great deal for you bag, they might just investigate the seller.

    Have you reported it?

    You will have to get a report from Gucci to say that it is fake - which won't be easy.

    Paypal might accept the evidence from you if you can follow the info on this link http://www.ehow.com/how_2074093_spot-fake-gucci-handbags.html

    But they would probably request something more independent.

  • Just advise you will go to the police, don't bluff actually do it. Handling of counterfeit or stolen goods is a criminal offense and to argue with you would be foolish if it is clearly counterfeit. Simples

    That wont get your money back via paypal though. Your better off trying to get independent confirmation for paypal. Get your money back that way then reporting to trading standards. The police i doubt will do much and are more likely to pass it on to TS anyway. In the meantime you will be unlikely to get your money back

    Without sounding harsh I think the old adage 'If it seems too good to be true...'. The fact it only went for £43 suggests that other potential purchasers could tell it was fake.
  • Send the seller an email stating you will go to police and trading standards,also say you will be taking the bag to Gucci and they will require their details so unless you receive a refund they will be forwarded on. You are also entitled to a refund without sending the bag back as is offence to send counterfeit goods in post.

    Just as devil's advocat here....what if the seller thought it was genuinely a Gucci bag?? Which is partly why I asked if they were selling other items...

    It could be that they are scared to death by the tone of the OP's messages and just don't know what to do.....MAYBE!!!
