my partner has been with his company 9 years and hes had a few problems with them over different things,they laid him off couple months ago after my second son was born but he was back into after a week off.over two months ago he was off sick for a 2/3 weeks with his eyes due to the work he does hes a fabricator welder an hes had to have his eyes drilled over metal goin in them so he went back into work and got handed a letter saying he would be laid off due to low sales he was the only one being laid off in the company its only a little firm in the letter it stated that he wasnt losing his job and to make himself available to work when they called him so he did a month passed with no calls nothing to say what was going on he got his first weeks garentee pay but he didnt know wether he could sign onto jobseekers so he didnt do that till the 4th week so he got in contact with the citizens advice and he explained to them he felt pushed out and victimised as theres no one else whos been laid off or nothing and theyve tried this before.A week and half ago he sent a letter in as it was the end of the 4th week asking about being made redundant or they would supply him with work he had no reply in letter or phone call so hes just sent in his notice asking for redundancy pay and his holidays hes earned and his wages for the weeks notice.im just looking for some advice on it as weve tried everything to get advice but cant seem to get any.should they get in contact with us this week ask its coming to christmas they close christmas eve.we have a mortgage to pay i have two young children its hard to know what to do in this circumstance.

if you OH has actually sent his notice in then he has resigned so will not be entitled to any redundancy pay, if Im reading it right.
He should have just asked to be made redundant.
I think after so many weeks the company has to offer redundancy.
Can you elaborate as to what letter he actually sent.
edit - if he had worked for them for 9 years, he is entitled to 9 weeks notice, (not 1) and 9 weeks redundancy pay as well as any accrued holiday pay.make the most of it, we are only here for the weekend.

Whether he's redundant depends on the contract of employment. Does he have a copy? What does it say about lay-off, e.g. are his employer entitled to keep him laid off forever or is there a maximum period after which they have to make him redundant?
Why doesn't he ring up and asked for a meeting with his manager to sort this out? If he quits he will not be legally entitled to redundancy pay.I am an employment solicitor.
