HSBC letter

I received from HSBC yesterday a letter saying I will not get my bank charges back. I took HSBC to court a couple of years ago, before there was the "stay" in cases.

Is there anything I can do now or is this the end for bank charge reclaiming?

    The brutal truth though seems to be that the claims for refunds of past charges, whether at the banks, in the courts or with the Financial Ombudsman Service (FOS) are dead in the water.
    "That is the end of it," a barrister who specialises in banking told the BBC.
    "All these actions will be struck out - there is no basis for them as currently constituted."

    It's certainly not the end imo, there are many more routes that can be taken.

    The OFT are to make an announcement on Tuesday as to their next move on bank charges.

    I would wait for that announcement, and then see what everyone recommends doing.

    Don't give up though! As Martin Lewis said, don't plan to get any money back and then if you do it will be a nice bonus.

    A spokesperson for the Judicial Communications Office said:

    "The judgment is quite lengthy and the parties to proceedings currently pending before the courts will no doubt require time to consider its implications for their own cases. Where proceedings have been stayed it is for the parties in the first instance to consider what steps to take in the light of the judgment and, if they think it appropriate, to apply to have the stay lifted and for any further orders. Now that the legal position has been clarified it may be that the parties can reach agreement on what steps should be taken. If they cannot, applications will have to be made to the court. Judges will consider such applications individually and make whatever orders they consider are appropriate in the case before them."
