Ebay shopping

I have bought a DVD from Ebay. Got it, turned out to be a fake. Soon as I opened it, it was obvious. Reported to Ebay. They removed other articles the seller had up.

Paypal are asking me to prove the dvd was a fake by a third party. If I don't it will go on the seller side. They also sayed(paypal) that as there an online busibess they don't have time to go through items reported etc. Yet if I send a report in that it is fake. They will investigate. Yet they clearly are not, as Ebay would confirm.

What is my position here? Surely it should be up to the seller to bore this responsibility?

  • No, under Paypal rules it is up to you to provide evidence.

    Have you tried just opening a dispute? If the seller doen't respond within 2 weeks you get a refund anyway.

    Try and get the wheels in motion regarding evidence before you open the dispute though as this can take a while, as I understand it with DVds a letter from a supplier eg HMV saying it's fake may be sufficient or you could try trading standards.

  • A retailer isnt going to have time to write you out a letter for goodness sake. Can you not just send them a picture of the disc, may be compare it to the real disc?

    No, Paypal won't accept that. They always request 3rd party evidence eg an expert to write a letter to confirm it.

    Believe it or not, there are retailers who will do this. Schuh for example, in the case of fake Uggs.

    Ultimately, it's them that lose business when people are duped into buying cheap imported fakes so it's in their interests in the long run.
