Advice Needed:landlord hasnt protected deposit and wont return all of it

  • well there is the 3x incentive to go to court but i get stepped on all the time by landlords im not letting it happen again even if it is only a small amount. im also going to talk to all the flats in the block and get them to check if he has protected would be interesting to see how the landlord reacts to 7 court cases
  • Threatening your landlord with 3xdeposit smacks of rampant opportunism. Exactly how much time are you prepared to waste and how much aggravation and heartache are you prepared to go through for the sake of a measly 35 quid?

    Accept the deduction and get on with having a happy life for goodness sake!.

    Re 3xdeposit court cases, there have been NO judgments in favour of tenants where the deposit was returned, or where the LL lodged the deposit before the court case.

    one judge ruled that an ex-tenant cannot sue for 3xdeposit as the legislation says only tenants can sue.....

    do some reading before wasting yours, and 6 other folks, time and effort.....

    Indeed, though I meant nothing out of the ordinary is evident (and certainly no £25), rather than the AST itself was a standard document, uniform for every UK Tenancy.

    I think it's very much a positive thing if tenants go after inappropriate deductions, even if small - it may discourage landlords from doing this to other tenants in future. These deductions can really add up (if LL does this to 20 tenants, this is the best part of £1k of tenants' money taken).

    Going after inappropriate deductions is a perfectly reasonable use of the legislation here imo.
  • You're entitled to your opinion as is anyone else but I certainly wouldn't waste my valuable time and energy pursuing any landlord to "discourage" them for the sake of £35 or any figure less than £100 but I appreciate that we're all different, thank goodness. The OP is likely to be wasting more than £35 in postage charges so they've obviously got much too much time on their hands.

    £35 x 20 = £700 - ie much closer to £500 than £1000 -

    but some folks on this forum never miss any opportunity (no matter how contrived) to further demonise landlords....

    we are not all bad.......
