Hi Im starting to get desperate with my debts and the number of problems that seem to be building up. So if anyone can advise with my following problems Id be very gratefull. (Sorry theres a lot and Im going to waffle)
I currently have a debt of approx 35,000 in credit cards loans etc all unsecured. (I say approx as you will see later)
Right the problems I have are.
1/ County court judgement. I had a debenhams card which through my own stupidity and forgetfullness managed to forget to inform when I moved house. After a couple of month I remembered and contacted them and informed them. However I was informed that as I hadn't made a payment or contacted them they had handed my account over to a solicitors and contact them.
I promptly did this and was informed that they were going for a CCJ against me if i didnt contact them. I wrote of with the information the requested and sent it recorded delivery (signed for) a couple of weeks later I receive a letter saying as i hadnt contacted them they were proceeding with the CCJ calim and i had 30 days to stop it.
I wrote again to them saying I had written to them and provided photocopies of the receipt from the postoffice and a photocopy of the signed form the post office sent to say it had been delivered. (I had also phone every lunch time from work only to be put on hold).
Again I wait and again again another letter saying the same as before. I have written loads of letters all sent recorded and the solicitors handling the case simply ignored it and I now have a CCJ against my name. I tried contacting GE capital (debenhams card financers to tell them but i just got speak to the solicitors dealing with it)
I wanted to know as the solicitors were signing for the letters and must have been getting the letters can they do the "Dont you keep on ignoreing" us thing and get a CCJ against me or have they broken the law in any way? (Sorry for the long windedness but i thourght id put you in the picture)
2/ IVA's With the amount I owe I have worked out that i can afford about 250 a month to pay off my debts. Is an IVA an option with this budget. I have used an online calculator and it said i need to go for bankrupcy. Is this my only choice.
If so who wuld be best to go to for an IVA.
3/ Independate Parties? Are there any independant financial advsors that I could approach for unbiased advice. I spoke to CCCS and they seem to be all DMP, IVAs arrangers are all IVAs and others just want to sell youa loan. Is there anywhere (Apart from here) I can say heres all my debts heres my budget can you sort this mess out please. Mainly couse im aboslutely appalling at sorting things like this out. (Is there anyone on here willing to volunteer)
4/ If i was to go for an IVA would my psrtners finances have to be taken into account. were not marred just living together? I don't really want to get my problems dumped on her.
5/ Debit cards. As you can imagine I have a really bad credit rating especially with the CCJ. Is there an account that will give me a switch/solo card. I dobt want overdrafts or the ability to go into debt but I do buy a lot over the internet and its usefull to pay for petrol. I have a switch card at the moment but I feel if i enter an IVA HSBC will take it off me as there credit card is with them. I want to opena safe account but cannot find anywhere that will accept any advice.
6/ Im currently in the procees of trying to find out exactly how much I owe to who and to what APR etc but several seem to be ignoring me. any advice as to what I can do.
Finally I was on a CCCS scheme but they kicked me off as i forgot the debenhams card and they claimed i had applied for more credit and broke the agreement when I hadnt. (Just in case anyone suggests a CCCS scheme.)
HELP PLEASE
Thank you in advane and sorry for the waffle.

1) In respect of CCJ, this can be overturned, if as you say, you sent the necessary documentation. You apply for form N244 along with reasns why you want judgmeent to be set aside, copy all documentation etc. CAB can do this for you.
2) Everyone is different, and i really would take advice here.
3) Payplan, National Debtline or any of the other free companies will help with this. They need all the cards on the table for you though.
4)I don't think so, but we have a CCCS councellor on the forum who is very friendly and approachable and I am sure would be only to glad to advise.
5) Try a Natwest step account, I opened this online and got a solo card, it was all done and dusted inside a week. Also maybe you could consider a pre-paid card, which may help. Careful consideration would be needed her though, i use a cashplus mastercard available from https://www.mycashplus.org.uk
6) Right to you creditors, send a 1 pound postal order, and tell them under the Consumer Credit Act 1974 you want a signed original copy of your credit agreement and a full statement of account. They have to comply with this, send it recorded delivery.
If you want me to expand on any points let me know.

Firstly Thank you to everyone for A/ the helpful advice and B/ being nice.
As i said with trying to find the exact figures is one ofthe things i am (or was thanx MCBAINES) ill sort out my SOA tonight but the debt figures will have to be guestimates but should be within a hundred or so. will pretty much depend on the charges and interest I have been charged. Ill then update it as i firm out the information.
Thank you again.

On your figures, I think an IVA is possible. Any reason why you shouldn't go for bankruptcy?0

Sorry for the delay had a hectic week at work and been unable to create a SOA. Ive started one and will updated it as soon as possible to make it more accurate.
Income
Wages (Take home) – 1528
Expenditure
Rent – £525.00/month
Car Insurance – £80.00/month
Petrol - £200.00/month (I have to commute 300 mile per week)
AA - £42 /month
Food - £450 / Month
Road Tax - £165 / Year
As for house bills my partner is out of work/student/mum and the money she gets coming in Tax credits etc covers these (Sorry she has asked me not to break her finances down on here). Also the food bill is so high as Ive covered cleaning good etc and I have 3 children all under 10.
Debts
Overdraft £0 - (£500 limit) Only kept as a lower interest barrier incase of accidential overspend
HSBC Credit card - £3800 at 15.9% APR (currently trying to pay £100 per month)
Debenhams Card - £440 paying £15/month negotiated myself
MBNA Credit Card - £3900 ? APR (however had an offer would like advise on please see below)
The following debts were covered under the CCCS before the kicked me off there scheme. (Im paying £146 per month)
Natwest Loan - £17828 negotiated at £51.43/month
Natwest Loan - £4960 negotiated at £37.14 / month
Natwest Credit Card – £2203 negotiated at £24.86 / month
HFC Credit card – £2888.04 negotiated at £32.57 / month however HFC offered to change to an interest free loan for the amount to be repaid at the agreed amount which I took.
CCCS informed me these were all negotiated at no interest.
I have received a letter from MBNA today saying if im willing to make 1 payment of £68.88 one of £86.67 and a final one in August of £1372.17 (Three monthly payments) They would scrub the rest. My mother has a cahoots loan she hasn’t used and has offered to pay the £1372. Aslong as I pay the loan off. Is it worth taking her up on the offer and getting rid of that debt.
Im sorry the SOA isn’t complete but I will alter it and make it more accurate when work eases down.
Any advice appreciated.
And thank you in advance0 -

The main reason is as a QS it can affect anychances of being offered Partnership later in life. Also Im not too sure where the RICS stand with it.
Also stupid as it seams I feel bad about trying to worm my way out of paying If i could earn enough off Im happy to pay it.
OK i appreciate the financers will try and bleed me dry but its just the way i feel. Must be stupid i supose.0
