why won't a shop give me my money back.

My son yesterday after work, purchased a pair of Jeans from our local scotts shop
he didn't try them on, because he was full of dust from his job, the jeans do not fit him, and today we tried for a re-fund, and they do not give one.

they have an on-line website which does refunds but not instore
can this be right in this day and age?

shops don't have to give refunds if they don't fit but most shops will as an act of good faith - could you try phoning them and appealing to the manager ?The mind is like a parachute. It doesn’t work unless it’s open.:o

Yup Sale of Goods Act entitles you to a refund if goods are faulty (that's a bit simplistic as it's a but broader but it doesn't matter to you in this situation), you are not entitled to a refund in store just because you've changed your mind/don't like them etc. Lots of stores do allow refunds for any purpose but that is in addition to your statutory rights and they don't have to.
Online is different as the Distance Selling Regulations entitle you to a period in which you can change your mind.Piglet

he bought them because they was in the sale, reduced from £80 to £40
all the others are still £80 and he's not got the money to put to for a pair,
stupid us, we just thought that shops did give refunds..........:o0 -

OK, makes sense. It looks like he's had it then with the jeans, best bet would be to exchange for something else.

Perhaps he could ask for a credit note if he can't afford them in another size?
Or as someone else suggested, flog them on ebay if they're worth £80. He could put a starting price at £40 maybe... (and make sure he clearly lists the measurements of the jeans!).Should've = Should HAVE (not 'of')
