I have a range of debts which i really want to sort out, and uptill now I have managed to get by and even pay a little bit off some .
But I have just been told by one company they are going to take me to court and make me bankrupt. I really don't know what to do. I owe them about £2,200 and I have offered them £100 per month but they refuse to accept it saying I must pay them £500 immediatley and then at least £200 a month which I cannot do. They apparently toook me to court in january which I found out when I got a judgment through but when I have spoken to them they said they never took me to court...
If they make me bankrupt will i lose my stuff? I am worried that they may take some of my partners exspencive things as i have nothing really worth taking and I rent a flat.
I have to be very careful with any contact with them as my partner works for the company and after I spoke to them last week and said they will probably end up with nothing and i could not pay them, they hauled him over the coals at work and gave him a final written warning over nothing. I think this was just to get back at me,or scare me as his is the main income in the house
which has worked as it caused loads of hassle last night.
I don't know what I can do about any of this i just don't want to lose everything and end up with nothing any ideas would be great ....

I would contact the CCCs or payplan as they will be able to help you repay them and work out a better way to repay them
Also i think that professional companies do letters better than you or I could, for the simple fact they deal with this day in or day out.
Is the debt only in your name?
If so im pretty sure they cant sack your partner as although some financial companies wont keep people who are in severe financial trouble (as they deem them a security risk), if it hasnt nothing to do with your partner then they are in the wrong

If you received a Judgement then that would indicate you have a CCJ, Do you still have the Judgement? If so can you tell me what it says in brackets under Judgement?
Depending upon the type of Judgement it was there may be some action you can take.
Also so long as you can prove your husbands’ items are his then they are safe, they can only seize assets that are yours.
What do you do for a living? This could be important.

Thanks for the quick responce, it's not a financial organisation its a child care company and OH works at one of thier nurserys.
I can't do much work as I have 2 young children but I am self employed as a researcher and Mystery Shopper, i try anything that earns a little to help us out .
Debt is soley in my name I am cannot find the judgement paperwork now
I will do a SOA after and post it later and any help would be great, thank you both for your replies
Ooooh and I don't know if it matters but I'm not married i got divorced from my wife ages ago and now have a wonderful boyfriend that lives with me and the children0 -

My work is approx £100 a week
OH wage is £150 a week approx
Child benefit is £29 a week
Outgoings
Shopping and whatever we can pay from the bills, who ever is shouting at us the loudest. but the regular bills should be
Rent £55 Wk
Council Tax £20Wk
Water £20wk
gas £7
Electric £8
Petrol £20
NTL £30 approx( TV, Net and Phone)
Debts
Halifax £11700 (due to old house repo 10 yrs ago)
Capital one £155
Old Mobile fone bills total £500
Water Rates arrears £300
Shoppercheck £300
Childcare company Debt £2,200
Old cable bill £150
Financial Advice bill £350
I also have £4000 of really old debt from credit cards and a loan they have not been in touch for years but probably worth thinking about as I seem to be trying to face up to it all
I also get maintanence payments of about £150 a month but this is not regular as have massive probs with CSA so I would rather not include this also if and when we do get this it is nice to have a treat.
There may be a 2 or 3 other little debts £50 here and there which I may find, will update if I do0 -
could either you or you oh work longer hours or in a better paid job? Could you work in the evenings when he gets home from work? Not ideal I know but the basics to all debt free wannabes is get less going out and more coming in!0

I have been looking around for weeks for anything that I can do around the kids but it is difficult as he works different shifts each week and only finds out on a friday what he is doing the following week... he is bank/flexi staff so his hours are not garunteed or regular, and I can't ask him to change jobs just coz of my past financial probs coming back to huant me.
Also after the problem with his employer I think he needs to take what he is given and not cause any fuss or they may give him more grief or sack him.
Oooooooh i dunno everything is just swirling around my head and making me cry every 5 mins :-( i feel completly useless coz everything is in my name so i feel responcible for it all.0 -

what do you pay monthly for each of your loans? Or, what are you meant to pay?
My initial thoughts are :-
1) Need a full breakdown what you pay for food and other general items.
2) Old mobile bills, i would send a letter and ask for a copy of the Credit Agreement you signed for this. If they fail to produce one, that debt is not enforcable. I would also write to Capital 1 and the others, and ask for copies of the credit agreement, then you can see what is what, whether you have had excess charges etc added. If so, these credit card charges can be claimed back. just 1 step at a time first though.
Do that with all your creditors and include a 1 pound postal order. I can do you a letter to send if required.
The bills that are several years old, how many years old roughly? After 6 years they become statuted barred and you cannot be chased for them if there has been no acknowledgment in that time that you owe them.
Got to go take my mum to Iceland shopping ;-) but will post some more later. Well done for facing up to your issues, you are amongst a supportive team here and should be fine.0 -

I have no idea how much i should be paying, they are very old i took them out 10 years ago but not sure when the last contact from the collectors was. the halifax debt was from years ago but they got a CCJ 2 years sgo for the debt, the debt was the charges incurred with the reposseion (10 yrs ago) and intrests and they have not been in touch to try and get any cash either
The company I am really worried about more than anything is the childcare company as they are the ones saying they are going to make me bankrupt and thats where my OH works and is getting hassle because of me and what i owe them.
I am scared of trying to talk to them again in case my OH gets more trouble but aslo scared in case they give him hassle if I sit and leave it.... or if they get funny with him if they make me bankrupt or anything ....
I don't really know what we spend on shopping to be honest although we both smoke so that costs a fortune (about £80 a week) there are 2 adults and 2 children in the house and a cat n dog I know we spend far to much though.
Some help with writing to creditors and sorting it all out would be great ( someone to hold my hand kinda thing and help me with dealing with it all step by step)
Sorry i'm not being much help am i, the worst thing is asking for help as i have never had to do this, believe it or not I actually sorted my OH finances out for him completly last year, but i am just fed up and have run outta steam and cannot get my head around mine all i can do is get upset.
