Tesco trying to rip me off!!!

I took out insurance with Tesco during their promotion of "Free pressure washer with each policy". After 6 weeks of hearing nothing I phoned up to ask where it was. They said I had to register a clubcard. As I didn't have one they accepted my partners, no problems. I still hadn't heard anything back so I chased them again and they said everything was in order and it would be pushed through.
I phoned them again this evening to chase it again as I still haven't heard anything. They said I'd breached the T's&C's by registering another card. This is even though they had accepted it previously!
I stated that under the Sales of Goods Act they had to honour the promotion (not sure if this is true I was using the "scare them with legislation" approach). They've accepted I was wrongly informed and offered me a £50 "Good-will gesture". I've refused this as the pressure washer is worth £100 and the complaints department are going to call sometime within 7 days.

Any advice?

    Did you know you can register a Clubcard and "link" it to your partners? Why didn't they suggest that to you?

    Their terms and conditions are not relevant any more. They allowed you to register your partner's card under the promotion, so it is them that have breached the T&C's; not you. Under contract law, you have to have "offer and acceptance"; you offered your payment and a clubcard, which they were aware was not your card, and they accepted it. They have to comply with the remaining terms of the offer, but have waived any right to refuse delivery of the pressure washer due to you using someone elses clubcard.

    You have the protection of the Sale Of Goods and Services Acts as well as the Distance Selling Regulations. Feel free to tell them that. They are highly unlikely to ask you which parts, but if they do you can always use one of my favourite responses; "Look it up yourself. I've got my own job and I'm not going to do yours for you as well".

    Stick to your guns - suggest to Tesco that sending you the washer AND the £50 of vouchers will prevent you from passing the matter on to the Financial Ombudsman Service. They have inconvenienced you and under the FSA Handbook "DISP", they should not only put matters right (give you the washer) but should also consider whether redress (compensation) is in order. That would usually be somewhere in the region of £20-30 but if they want to do it as a voucher then it should really be £50; cash can be spent anywhere but their vouchers don't work in HMV!!

    Yes, if you have nothing but time on your hands there is a matter of principle, but i can assure you, the pressure washer is worth little more than the £50 you were offered.. I got one under the promo myself and would honestly have rather had £50 off my policy.

  • tosh.. its a very valid point and have no idea where i have said something thats not nice..

    Tesco are not ripping this chap(ette?) off in the slightest as the title suggests..

    I'm simply advising him their offer of making good the error is a very good one and compensates them more than enough for the oversight.

    (Actually, screw that, perhaps we should just sue them eh??) please....

    It never ceases to amaze me that people "jump" at these offers without reading the terms (I am sure it weas clear you needed a clubcard to qualify) and then complain that they are being ripped off when they get turned down.

    Try this next time - Read before you jump! - also (I may be missing something here) in the time it takes to complain to Tesco's and to slag them off on here - would'nt it not have saved more time in the first place if you got a clubcard (or even read what you applied for)?

    As I clearly indicated in my initital post, they were happy to take my partners.
