Please can someone help

Hi, I have just got off the phone from our mortgage company, it was awful and i am completely lost now.

Basically as you may know we left our house very quickly after being made BR we told them they could have it and they sent the forms for volutary repo, thankfully we didnt sign them but didnt get round to sending them off either with one thing and another, so now they have rung and when i said we wouldnt sign anything they said we couldnt do voluntary repo in that case and they would have to go to court which we would have to attend, get legal advice, state our case and have court costs added to the whole thing. I said we had no intention of going to court and that the house was empty and they should just do what was cheaper for them to do so they started talking about house abandonment, they wont take our word for it they have to do checks etc incase someone has moved in!

If you are confused reading this you will understand how i feel now!

Any way i asked them to ring the OR they refused said they didnt see why they should, they prefer to sort things out with their 'customers'. I have now said we will type a letter (any help would be great) but would not sign it, they said that was ok and they could then start all their checks, but i dont know what type or what route they will go down (to be honest by this time i was losing the will to live!)

oh yeah and then they added by the way is there any buldings insurance on the property because if there isnt and something happens we are responsible not them, i explained that i was BR and could not afford to insure a property i was not living in they just said again it would be our problem if anything happened!!!

could anyone please explain to me what the ins and outs are of these 3 options and if we will be responsible for anything depending on what choice they make

    Abbey to reposs on 24/12/09 they are taking me to court but i'm not going i moved out 5 months ago today and i've been telling them to take it.

    Got my appointment and then wrote the judge a nice letter saying sorry can't attened can't afford to take unpaid leave, here is my BR ref number, Happy christmas

    Took it to the court and gave it to the clerk and they said that should be fine

    I think you should have a word with CAB, as this needs some legal clarification.

    Thank you for your responses, my hubby keeps telling me not to worry but i cant help it, i just know i will say something to someone that will come back and bite me on the !!!!! everything was ticking along nicely till this week and i knew it was going to go wrong, i felt it.

    I will try the CAB but i know they wont be able to fit me in for 3/4 weeks so not much help at the moment.

    I would just like some clarification on the possible outcome for each thing they mentioned, the call was not the easiest and i didnt help by being firm and unbending (even though they were the same) but i dont do well at sticking up for myself which is why im so worried now

  • mines abbey too
    i havent paid my mortgage since june and we are still living here.
    they have sent me a court date 13th jan , and we dont plan on going to court
    we will be moving out begining of jan into private rented.

    Hi. Dealing with people on the phone about vol rep is a pain. Remember they do it every day and know what buttons to press to make you worry but don't.

    You must keep up the insurance on the proprty until it's repo'd though. You stated in BR that you would look after your assests and i'm afraid this should be done for your own peace of mind if anything.

    Any court costs wouldn't be passed to you as far as i'm aware. They want to take you to court then they pay the fees. I have had Northern Rock vol rep without their blummin' paperwork signed but it was a hard slog!

    They're trying to panic you into signing their forms for quick 'get rid' of. Hold your nerve because what they really want is for you to crumble so they don't have to incur the legal costs.

    It's a messy game and you have to be tough. You're BR no one and nothing can harm you now, just ball park playing - as long as you don't sign the deed of acknowledgement. Rog2 gave a good link, that is who I used when I needed help with vol rep, I qualified for legal aid too but to be honest all they said was don't sign the form, stand your ground and don't worry if it goes to court. that's all up to them.

    hiya lots of good advice here
    i have no experience of this but from what i read on here they know what to say to make people worry. i agree with mich about the insurance
    if they do insist on taking you to court, do what curly has done, even the judge agreed with what she was doing!
    send your letter and try not to talk to them via the phone if you can as they know how to worry you
    good luck, it'll get sorted in the end

    I wouldn't, normally, suggest this, but I do understand how you must be feeling. There are a couple of CAB debt advisers who post regularily on this board - debt-doctor and fatbelly (his user name - not mine.;))

    I suggest that you send a private message to them and ask for their advice.

    Well they appointed eversheds and they were a lot nicer than the people at the abbey

    dont phone them they will pass to evershed then speak to eversheds and then they will get the ball rolling but they will take you to court but they told me I didn't have to attend unless I wanted to try and keep the house. So like I said I just a little note to the Judge

    but remember

    JUST DONT SIGN ANYTHING
