they haven't charged me - what are my rights and obligations?

Hi there, I recently made an order over the phone for an item costing a few hundred pounds. I was going to use the company's website to make the order but I had some questions thus I gave them a call and ended up making the order over the phone and giving over my card details. The item was delivered a week early for some reason but thanks to a neighbour I had it in my hands a few days after the order. It's pretty much a month since then and they (the compnay) haven't taken a penny off me! I've checked the invoice they send and there's no mention of them taking the cash at a later date or me having to settle with them on a certain day or time? I've purchased from them before and they've taken the payment straight away.

What is my legal obligation and rights with this situation?

    Your obligation is to have monies available to pay for the item when the funds are requested. The retailer has up to six years to claim this debt.

    A common sense approach would be to contact the retailer and ask when they will be taking the funds. But then I doubt you needed somebody to tell you that?

    Best get it sorted however tempted you might be. I had a similar situation with O2 and never noticed that payment wasn't taken. More than a year later I was being chased by a debt collector and it took a while to work out what had happened before I could phone O2 to resolve the issue.

    If it's a well-organised company they will notice and it's not worth the hassle.

    If its an invoice which doesnt specify a payment method (i.e DD or them billing your credit card) then I would take this to mean you are to prompt payment yourself.

    Normal terms are 30 days so you should be settling within a month basically.
  • That's great - I'll contact them tomorrow morning and get this sorted out. Thanks for the advice, I certainly don't want debt collectors involved!
