ppi reclaim on egg card online application

i am new to this forum.
i have tried to reclaim ppi on my egg card which i applied for in march 2007.
i read about the whole ppi thing a couple of weeks ago and checked my creditcards. it was only then that i realised i had ppi with my egg card and that i was paying a fortune over the last few years.
i used the sample letters and wrote to egg, stating following reasons for my complaint:
This is due to the fact that as having recently looked at the paperwork for my credit card I now realise that I have been paying for insurance that I did not know I had taken out.

· I purchased the policy online as part of my credit card applications and believe that the use of check boxes meant that it was not made explicitly clear whether I was purchasing Payment Protection Insurance or not. This is a technique that is no longer considered to be acceptable by the FSA.

· This is due to the fact that you have been fined by the FSA for failing to treat your customers fairly when selling Payment Protection Insurance and I do not believe that my policy was sold in my best interests

egg was very quick and has now replied the following:

After carrying out a full review of your account, our records indicate that you purchased the insurance through the egg website on 8 March 2007.
our online sales process:
- does not require you to take ppi as a condition of obtaining the credit card
- does not provide any advisory service
- requires you to positively confirm that you wish to purchase this policy both during the online application and on completing your card agreement.
- provided full terms and conditions of the policy and requested you read them before submitting.

they enclosed a copy of my realtime application and said
... this information can not be changed manually by the egg personne.... on the second page towards the bottom, there is a box which reads, 'accident, sickness, Unemplyment and Life'. If you had not opted into Card repayment Protection during your application, this box would contain the word 'none'.

on this basis they are unable to uphold my complain and closed it. I have the right to refer to the FOS... etc.

I dont know what i should do now. I am sure the box was preticked, as i am really not aware that i took that insurance out.
Is it worth going to the FOS with that? will i have a chance? how can i prove it?

    Hi there

    Am sure somebody will be able to give you some help with this. It is difficult to prove as I am not sure when they changed their on line forms. I do know at one time that the boxes were pre ticked and you had to opt out of these. Are you aware of the dates that the fine covered?

    martins guide that that in july 2007 lenders agreed to stop using pre-ticked boxes. i applied for it in march 2007.
    is there any way for certain to find out when egg stopped using preticked boxes? or has anybody else had success in reclaiming ppi on an online application with egg??
    anything will help.

    I have received exactly the same reply from Egg today, word for word, dont be put off, I will go to the FOS with this. I already have an Egg CC PPi with FOS (with an adjudicator) so hope to have something more to report soon. We applied in 2001 and like you have no idea when boxes were preticked.

    Not that I am aware of I would just go for it argue with them and take it to the FOS if you believe that you did not willingly take this out. Write again and argue the point that you did not want the PPI and that you will take it to the FOS. Please be aware though there will be a wait of at least 18 months to get to an adjudicator.

  • Same situation for me exactly. I complained to Egg, they said no, I wrote again, they said no. I wrote to FOS, they replied within 1 month telling me they would assign someone within 2 months, last week(2 months after first letter) received exactly the same letter, telling me they are busy and someone will look at it in 2 months, so it's going to be mid february now b4 I get a look in, 5 months after I wrote to them.

    I argued the exact issue about pre-ticked boxes, and all they could muster up was a screenshot of their website as it is NOW, not as it WAS. They're just fobbing ppl off in the hope they will go away. I applied in 2001 online, and I know it definitely was pre-ticked then as Egg were cited as being one of the banks who partook in this deceptive procedure.

    Hi, I know that FOS are taking quite a long time at the moment but its often worth the wait so good luck and let us know how you get on.;)

    I have decided to write a second letter to egg as Martin said that it is normal that they refuse the first complaint.

    i have used the second template letter and emphasized on the pre-ticked boxes at online application. Please see below:

    Dear Sir or Madam,

    Account number: xxxxxxx

    I refer to my letter dated 5th Dec 2009 in which I wrote asking for justification that the insurance sold with my credit card was sold fairly, reasonably and within my best interests. A copy of this letter is enclosed for your information.

    I am writing in response to your letter dated 11 December 2009, with regards the insurance sold with my credit card. Your reference is xxxxxxx.

    I do not feel your letter has offered a satisfactory justification that my policy was sold fairly, reasonably and within my best interests so I request that you look into my complaint again.
    Until recently I was not even aware that I had PPI and I certainly did not and do not want it. At the time I took out my Credit card in March 2007 your online application process used pre-ticked boxes. It was not made explicitly clear whether I was purchasing Payment Protection Insurance or not. This is a technique that is no longer considered to be acceptable by the FSA. You have been fined by the FSA for failing to treat your customers fairly when selling Payment Protection Insurance, especially regarding the use of pre-ticked boxes with online applications.
    If I do not receive a more favorable response within 14 days I shall be taking my complaint to the Financial Ombudsman.
