I am really not understanding this lolDEBTMONKEY1A wrote: »DX2, Sorry...she put in her DLA claim third week of April...ESA not claimed till contract ended 25 May. yes-seems a long time to want to claim back to-they already have backdated it to the standard 3 months but as she is disabled (she HATES that description!) you can ask for it to be backdated MORE than 3 months....
How can you be trying to claim any further backdated wtc if she didn't get her DLA sorted out until April and she ended her employment in May
*SIGH*

Dx2...it's a joint claim. I've been working (allbeit on sick pay-statutory) since April. She APPLIED for the DLA in April & it was awarded towards end of June. This is where the Inland revenues technical manual (oh the joy of the internet!) to my rather un-technical brain (!) says that if a person is disabled they can ask for the WTC to be backdated to the date DLA 1 was first applied for -& apparently you have THREE months from the date DLA notice received (end June so the 3 months takes us to end Sep) to appy to get it backdated to date of DLA claim. Apparently although three months is the rule it can be appealed based on circumstances.0 -

You get SSP, Carers Allowance and WTC
Your OH gets ESA and DLA.
And because your OH gets DLA you are trying to claim the disability premium for your OH as you claim WTC as a couple.
Can I ask how long do you get SSP for?*SIGH*

About 25 weeks total...(not claiming it any more-WTC people advised)not trying as such to claim the 'disability premium' it's just that it states online that they will consider backdating the full WTC more than 3 months for people with a disibility who 'tick all the boxes'. Other 1/2 had ESA (cont based) from end may to early Sep, employed (over 16 hrs) in same job till next May.0
