Basically I live on an A road, it has a 50 speed limit. I currently have to park on a Layby, There are 2 semi detached houses and mine and next door ar owned by HAand the other 2(attached ) are private.
Anyway our HA wanted to put in driveways and submitted an application, the council came out did some measurments ect and have refused.
They say they refused because of sightlines and the speed of traffic coming round the corner which is faster than 50.
My argument to this is:
1) surley somebody should then enforce the speed limit so it isnt a problem.
2) We have to pull off the layby anyway so pulling off a driveway would put us in exactly the same position only we could turn around on a driveway and be safer.
Is there anyway I can contest this?
Should I apply as an individual again, then contest it.
Ive asked my hA and they said I can do as I like, if I get the permission they will put in the Drive.
Has anyone any Ideas?

You can appeal a refusal but that is not to say you will be successful. Without seeing plans it is difficult to know whether you have a valid argument.0

these are the houses, as you can see the last 2 are private and have driveways already.
mine is the one furthest away in the picture0 -
i would appeal it. a small country lane should not be a problem area.
i would expect the traffic to be very light there most of the time?
ps.
i know the area fairly well, used to goto the Derby Arms many yrs ago.
they used to have a Mini on the roof!Get some gorm.0 -

Unfortunatly its not a small country lane its a A road that goes thru Ashbourne and into Derby, It's very busy all day and night, with lorries, cars and motorcycles. (hence the reason we want to park off road!)
Ive been intouch with the council and made some more suggestions, and if i dont get anywhere im going to get an appointment and see the planners see what I can do.
Not sure whats up with the link when I press it I see the pic!!!0 -
I'm confused when I click the link I get a country lane...
EDIT: the road it runs into is an A road but on the map its even called ---- Lane...#6 of the SKI-ers Club :j

I suspect the link does not take you to the correct photo and will display either a photo at a location where you last used the site or if you clear cookies a location somewhere near Blackpool (Back Lane)0

Do you have a fence or wall in the front of your garden?, if so, what would happen if it were to accidentally 'fall down' thus giving you access to your front garden?.
If that were to happen, then you could always create a 'gravel garden' with just enough space between the plants to park a car.
Just a thought. My friend did this, and the local council have seen it and in 20 years, have completely ignored it.Never Knowingly Understood.

TBH I think you probably won't win this one. If the reasons they have are road safety, then that's always going to take priority over what's convenient for the houses. However, I believe the kind of drive you are most likely to get approved on a busy road is a dual exit type, so you can drive on and drive off forwards. Even if there's room to 3-point turn on your land, they are very unlikely to risk approving anything that would mean people could try to back on or off in a 50mph zone.0
