Those who have paid by credit card, you will be protected. I would suggest not phoning straight away as the card companies are being in undated with calls
Some card companies will even automatically send out the disclaimer, I would suggest holding on for a few days until contacting them.
If you paid by other means, seek refund through ATOL or possibly your holiday insurance will cover it.

Is this definitely the case as I have booked flights with flyglobespan for April 2010 using my M&S Mastercard Credit Card.
I have been in touch with them this morning and it seems that they are going to send out the paperwork, but can't say how long the process will take and how much of a refund I will get. My understanding is that I will get 100% refund. Is this understanding correct? Also if I book alternative flights, can I claim the additional expense of these flights?
Many thanks0 -
No you can't claim additional costs for alternative flights. Also Article 75 does not apply to purchases under £100. If at least £100 you will get all your money back.0

Thanks for the reply.
The flights were well over £100 so at least I will get the money back.
Is there a required amount of time that the Credit Card Company has to deal with the refund? The person I spoke to said I could be waiting months.0 -
Sorry, I was probably wrong to suggest that you could not claim the extra if the replacement flights are more expensive. With a credit card booking you should be able to. How long refunds take vary from case to case. Sometimes it's very quick. On other occasions there is a lot of buck passing between the banks and ATOL about who should pay. Some of those affected by the XL collapse had to wait for ages.0

There will be a massive backlog for all card companies involved. They will make sure that the relevant paperwork/disclaimers are issued to you in good time.
A lot of this will turn automated. In some cases the company with either freeze the transaction on your account against interest etc or credit up front.
Just keep a log of any calls/emails you make and also keep as much info that you have been sent about your bookings.0 -
apt, thanks for the very useful information.
Would I be better speaking to the Credit Card company about the replacement flights before I book them, to understand if I am entitled a reimbursement of the additional cost. Would this be part of the claim?
(Replacement flights are working out about £80-£100 more per person)
Never had to do this before so I apologise if these questions seem a little silly.0 -
Yes, I would ring them up, although that won't change the legal position and the fact that the credit card company is jointly responsible. Here's a useful article about making claims - http://www.guardian.co.uk/money/2009/mar/29/credit-cards-consumer-affairs0

apt, great article link to the guardian website. I'll get back in touch with the credit card company r.e. additional expense for replacement flights.0
