I have worked for 20 weeks a year for the passed 5 years for a large govt org.( self employed).
In 2008 hmrc assessed me as an employee. I sent assess. letter to employer they ignored it. I sent it again 7 weeks ago by placing it into his hand with a covering letter. I have had no response, They continue to pay me gross, and have booked me to work up to end march 2010.
I have heard through gossip that there will be no more work for me after end march 2010.
Am I an employee?, If employer simply refuses to discuss it or acknowledge the problem where do I go ??. Anyone got a suggestion?.
I have already spoken to acas and have been told that I am an employee.

Then your next step would be asking for redundnacy pay in writing as you are an employee and have been for 5 years (if there is indeed no more work)
And then check your house insurance to see if legal cover is provided.Debt free 4th April 2007.

If HMRC have ruled that you are an employee, then the employer has to take regard of this. You need to advise HMRC that your employer is still not operating PAYE. This will protect your position re claiming JSA, apart from anything else.£705,000 raised by client groups in the past 18 mths :beer:0
