Flyglobespan accepting books just one day before going bust

I think I already know the answer to this but I'll ask the question anyway (and hopefully someone will answer). I booked flights with Flyglobespan on Saturday and the money was taken from my account yesterday.

Of course now they've gone bust and other than trying the Visa chargeback procedure, it appears very unlikely I'll get my money back.

I just wondered if there is any kind of rules around a firm accepting payments literally the day before they go bust? Despite the company's denials they must have known there was a very strong change of going under. Shouldn't they have had to stop taking money or something?

As I said, I suspect the answer is that they can take money up until the second they go into administration but I just wondered if anyone knew differently.

    There will always be a day before but you did infact book four days before.

    From what I hear on the news there is something slightly strange about thgis one and the company was profitable but had problems with the online booking system? Weird

    The joys of cheap DIY travel :(
  • Sadly it wasn't exactly cheap - or at least I don't class £500 as cheap!

    Even four days before they must have known they were going under. And they shouldn't have taken the money the day before going into administration because they almost certainly knew then.

    It might be okay under the current laws but it feels like fraud.

    The management might have known they had a problem but until the banks withdrew credit they would more than likely think they could trade themselves out of it.

    Directors can sometimes become personally liable if they continue to trade whilst knowingly being insolvent.

    In this case it appears more like the banks/backers withdrew funding suddenly hence is unlikely to apply.

    I'm afraid unless you fall within one of the other avenues for refund your screwed.
