help me!!!!

I was crashed into, through no fault of my own on saturday. The driver hasn't admitted responsibility but I have 2 witnesses, and the police on my side. I called the police myself because my car was blocking the road, I was breathalised (it was fine) and asked to produce my docs. I have looked through my papers tonight and discovered to my horror that my mot was due 5th nov, I feel sick, I just had no idea. The fact I spent over £100 on my car last week surely goes some way in saying I would not have spent it if it was roadworthy, I am taxed and insured

    Dont think you need to worry to be honest, an MOT (or not) shouldnt have any effect on your claim on him.

    Never known an Insurance company ask for an MOT certificate.

    Im sure you'll be getting it done ASAP.
    I can never understand why we are not notified about MOTs, it happens with
    Tax and Insurance (yes I know its our responsibility but so is insurance and road tax.)

    Im sure peope more in the know will be along but i have read the same on these boards before.

    1. Get your car MOT'd now
    2. Cough to no MOT at the time of the RTC at the station when you produce your docs but take the new one and
    3. The vast majority of officers wont take you for no MOT - its more paperwork than what its worth

    Your/their insurance company however may take a dim view of it :o

  • The cars been in an accident. Theres a possibility it wont pass an MOT now.

    As suggested, just come clean.
  • sadly the car was written off so I've been told that the insurance company will request the mot so they will find out.
    As suggested I've been to the police and coughed and they were ok, although its down to the individual policeman that dealt with the initial incident to decide what to do so I'm waiting to hear from him.

    If you are claiming off your own insurance, just check your policy - a few insurers (eg Swiftcover, RAC) have made it a condition that the car has a valid MOT (if required), whereas the norm is for the car to be kept in a roadworthy condition (ie. no mention of MOT cert).

    If it turns out yours demands an MOT in place, then pursue the third party for recompense.

    (The lack of an MOT may have an adverse affect on the settlement value, whoever settles the claim)
