Returned unwanted Xmas pressie?

Options
Hi guys, i know its early but we've already done our secret santa at work and i got a present from Red5, which is a shop very similar to the old gadgetshop that used to be around.

Now its a small pool table, hasnt been used but there a small tear on the packaging. I phoned up the store asking about a refund and the manager refused and after a lot of discussion agreed to have a look if i bring it in store. His reason was i didnt have a reciept but i told him it was a xmas present!

I just wanted to know what my rights are, i thought we're allowed to return items at least for an exhange if i dont have the reciept! ps i know there is a little damage on the box but its perfectly sellable

You don't have any rights unless the goods are faulty.

Exchanges for non faulty goods are down to the stores discretion only. You have no rights I'm afraid.

Maybe ebay it or keep it and palm it off on someone else next Xmas? :D

  • hiya, yeah, its just a return / exchange because i dont like it,

i'll take it to the store and ask anyway, see what they say, just wanted to be a bit informed prior to going in.

    thanks!
  • I may be wrong but I thought that only the person who purchased it could return it as they have the contract with the store not the recipient of the gift (if it has been paid for with a credit card then the refund, if any, should be going back to that card). I might be wrong on that but I'm sure I've read it somewhere.
