  • Everyone says not to sign if your going bankrupt, but the fact is you should not sign if your ALLREADY BANKRUPT, if you sign and your already bankrupt you aknowledge the debt again and become liable to pay it making a second BR possible..

    Thanks Kerry

I have one question regarding voluntary repossession and bankruptcy. After reading on this forum it seems that Northern Rock will try and make me sign an acknowledgment of shortfall which everyone advises not to sign if going bankrupt.

I certainly won't be signing it but as the mortgage is in joint names and both myself and the ex (with whom im not on speaking terms with) will be contacted, if she signs this acknowledgment will that be like I have signed it also if you know what i mean ?

You poor thing. I am a casualty of Northern Rock also. If your ex chooses to sign then thats her thing. Just dont sign anything yourself. NR may drag their feet over vol repo without it-but they will repo eventually. The shortfall will be included in your BR-list it on your SOA.

Nope! if they were from before your BR and are provable, whether on your petition or not, they will be included on your BR and they cannot come after you in any way, shape or form and if they do then we have a letter to send to them :D

Does it matter? All that matters is the OP is after some advice and support from all accounts. A horrible time in the OP's life and is down. There's nothing underhand, there's nothing contradictory, just the same theme running through two desperate posts. OP is trying to find a way to move forward. Whther that is council housing, repo, bankruptcy nobody knows but the OP has the numbers for help from both of his threads and a shoulder to cry on here.
