Broken new shower screen - rights please on 'unfit for purpose' return or repair.

Hi, I wonder if I could pick some brains.
On 16th November we ordered some things for our bathroom, they all arrived fine but hubby came home and checked the bath and it was damaged. We called them and they came and collected it and replaced it the next day. Great service.
This weekend we put the shower screen on. It is the 4 fold type and not only does the middle jam when closing it (hubby has to prise it with a screwdriver to close it), water leaks out - we might as well not have it on there for the amount that gushes out. Hubby has tried adjusting it and he said 'we'll have to not fold it right out and leave some of the screen hanging over the bath to stop some of the water, but then that means it is not working correctly?
I called the company last night who told me that they would contact the manufacturer who would contact me as they were 'very good' and a rep would come and have a look at it and either replace or repair it on site.
The manufacturer called me this morning and said that he was the manager and their engineer was off sick and asked me 'where I got their details from' and 'what was you told was going to happen'. I explained the above and they asked for the company I bought it from phone number and said he would speak to them and then call me back.
Which he did not do. I've just called the company I bought it from and am waiting for them to call me back - so far they haven't either. It cost me £140.
Thing is, what am I within my rights to do? I want a screen that works. Can I just send it back to them and mark it as 'unfit for purpose' or do I have to wait for a repair. They say on their site I can return damages within 7 days and also they have a 30 day guarantee - this is up tomorrow - and a 12 month guarantee so I am confused where I stand and I want to be sure.

I want to get this done, I've been without a full bathroom for a month now and do not want to drag this back and forth between companies and be without a bathroom over Xmas too - especially if I can just return it tomorrow for a refund, I am confused by their 'guarantee though'.
Am I entitled to return it tomorrow via parcelforce (30 days is up tomorrow) and mark as 'not fit for purpose' and expect a refund for it - or not? I've seen one in B&Q that folds the same and I can't be doing with the hassle of waiting for a rep to call - especially if it seems the company have no idea what they are expected to do anyway. They changed the bath just like that but they are stalling on the screen so wanted some advice please. Can anyone make out what I am entitled to do as per their T&C.

I would bide your time here and give them an opportunity to fix it.

What qualification do you think you need? It's a showerscreen.
OP, reject it, give them a call and get a returns number, and send it back.
tbh, I've fitted dozens, and you get what you pay for, good screens are pricey.
Edit, I've just read the t&c's, and can't see the 30 day clause, but tbh I wouldn't use anyone with t&c's like theirs.0 -
Thanks for the replies. I've had a call from them since and they have tried to fob me off with the manufacturer. They told me they had faxed everything to them. I said that my contract was with them and not the manufacturer and when I mentioned the SOGA she turned all huffy and said said 'fine'. I have said that I'll give them til tomorrow to contact me and then I'll speak to TS about who the contract is with.
She was trying to say she was having nothing to do with the fault at all and they were not to blame for it.
I think we are going to get another locally and send this one back. I'll check with TS tomorrow as to what is the right way forward and go from there.
I checked the SOGA and it says that the person I bought it from is responsible for sorting it out but they are adamant they are having nothing further to do with it and that it is nothing to do with them.0 -
OMG, I said to them on the phone I wanted to get it sorted before their 30 day period expired which was tomorrow and now all reference to the 30 days guarentee has gone. If anyone can find anything that would be most appreciated.
They have really annoyed me now :mad:. I guess I will be speaking to TS tomorrow after all.
They had a huge 30 day guarentee banner on the top of the site on the T&C page!! :mad::mad::mad:0 -
And it was my husband that fitted it. He is an engineer - and more than capable of fitting a shower screen!0
