Bailiffs on the door step

Hi Everybody
Have not visited this site for a while been trying to keep head above water. It has gone under, I have my BR date for January 6th. Meanwhile, and I am sorry if this has been covered before. A Bailiff turned up the house yesterday I was not in but my wife was, she said he was very nice etc etc but took photos and details of the car on the drive. He has left me with a notice that says he has seized the car in leu of the debt, my worry is that come Jan 6th when I will be made bankrupt can they still then come along and take our only means of transport. I have not signed anything and nor has my wife. Any advice greatly appreciated.

  • The car now belongs to the bailiffs, not you. Did you actually own the car outright? Do you need this car in order to do your job? Note that is not the same as asking if you need it to commute to/from work.

    If the car is yours then they can seize it. It may well be worth contacting Herbie to see if anything can be done. What kind of debt was it? What sort of charges have they placed on the debt? Do you have a breakdown of their charges?

  • Yes the car is owned outright, and I do need it for work it is a straight forward saloon car.

    When you say you need it for work, do you have to use a car as part of your employment or just to get to work? Is there any public transport option?

    Define "need it for work". From a bailiff's point of view you can't take tools of the trade, so a travelling salesman or a taxi driver couldn't lose the car they use for that job. However "the commute is a right devil without it, really it is" doesn't count.

    OK the car is not just for commuting my job involves doing work for dental surgeries and I have to travel to and fro picking work up turning it around, sometimes in a couple of hours then delivering it back. It just would not be viable on public transport. Also there is no set pick up time each day, I might no go to a surgery at all one day, I could be there 3 times another day.

    The debt is to a courier company for just over a grand this was with my business that went bust just over a year ago. I then worked for a hospital for a while, but could not make ends meet so have gone back to being self employed in a different area of dentistry.
