All you now need to do is prove the allegation made. i.e. that the T&Cs are unfair and you'll be the king of the forum
Perhaps you should have studied harder
If he were to take it to the County Court under the Unfair Terms in Consumer Contracts Regulations the burden of proof would rest with A&L to prove their terms were fair, not for him to prove they are unfair.
To be fair I wouldn't expect you to know that as it doesn't feature in the Ladybird Book of Law.0
