Okay thanks for the info Phil. You may need to enter an amended Particulars of Claim before the hearing and you WILL need a witness statement - which you can do around 14 days before the hearing. By then we should have a much clearer picture on the situation and you have a fair time before you need to do anything.
Sadly Nattie is right the Court wont lift a stay on the basis of hardship, but they may well do on the claims due to the judgment in supreme court so you will be in a vulnerable position once the stays lifted.
We'll help all we can, just give me, or Nattie, a nudge after christmas (as the OFT should have made their decision then) and we'll help. xx
For the moment tho - shall we have another look at your hardship and try appealling strongly to the bank to bloody well help you as they should ! ?
