Court

Hi, I have received a notice from highview Parking Ltd asking me to pay an amount of £70.00 (£40.00 if paid before a certain date)
I have read all the advice on this forum and will ignore this completely but my questions is:
If this case did eventually end up in court for what ever reason, would I have to pay the court costs of the company that is claiming against me and how much is it likely to end up costing me all together?
I know it is very unlikely to ever end up in court but I just wondered
Thanks

Do they know you were the driver? If no, how would they initiate court proceedings? They can only take the driver to court and they only know that you're the registered keeper - unless you contact them and tell them you were the driver, and why would you do that? Just laugh at them and their pathetic begging letters.0

You would only have to pay their costs (about £80-£100 on top of the charge) if you lost in court.Flipfamous wrote: »... If they issued a claim, you can enter a defence, and if they persist with the claim you end up arguing it out in front of a Judge.
All of which is about as likely as Shergar winning the 2010 Grand National, ridden by Lord Lucan.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.0 -
Im guessing they do know I was the driver because it is a camera controlled car park, I'm not sure how they work, whether they just get the number plate or if they get the driver too, it says 'we are holding photographic evidence on file to support this claim'
I would like to see this but I am taking the advice of not to contact them at all.0 -
How does a camera prove that you were the driver? Unless they have some amazing face recognition equipment which matches a person's face up with their identity, there is no way they can identify you as the driver. They need you to own up to being the driver, or they need some substantial proof that you were the driver, such as you admitting to being the driver in a letter. This is why they encourage people to "appeal" their fines, they want people to write to them and admit to being the driver. Without you admitting to being the driver, they have no leg to stand on.0

Please remember to tell others, when it becomes common knowledge that charges made by these scam artists have no legal standing, the whole sorry business will end. I can vouch for the quality of the advice you have been given.Still waiting for Parking Eye to send the court summons! Make my day!0
