HSBC were paying my charges back in monthly amounts under financial hardship and I just phoned today to get this month`s payment and they said they no longer have a financial hardship team as the courts ruled in favour of the banks.

They still need to treat people in hardship properly and fairly regardless of the test case.
On what basis where they repaying charges monthly ? (ie whats it say in the original letter offering that repayment)LegalBeagles0 -

How can they continue to give hardship payments if they no longer have a hardship team to deal with them?0 -
We need to look into your case properly and get another letter off to the bank.
You are still in hardship regardless of whether they have a hardship team or not, and regardless of the judgment in the test case.
Originally you sent in income/expenditure sheets and evidences of priority arrears ?
Did HSBC do anything else to help with the hardship - stopping future charges/moving to basic account etc that kind of thing ?LegalBeagles0 -

Have asked for clarification from HSBC but they still have a duty to deal with customers in financial hardship. Most banks will have what is called an exceptions process which could mean that hardship would lead to some charges being refunded during the period of financial hardship. The Lending Code also puts a certain onus on you to deal with some of it. For example, have you contacted any priority debtors and explained the situation that you are in and asking for their help ie longer repayment dates, etc,etc,?0 -
The debts I have are with HSBC in the form of a £5000+ consolidation loan.0

did they arrange that after you indicated your hardship ? also is it a 'normal' loan or a 'managed' loan ?

I think it is just a normal loan. It was arranged before I was in hardship.0
