This week i went with my partner to buy snowboard helmets

We wanted a particular make and found a shop near to us stocking this particular brand. We went to the shop tried some and were delighted they had the colours and sizes we wanted and so both purchased one.

However when in another outdoor/snow sports shop we spotted my partners helmet and on closer inspection found there were minor differences to the liners. When we asked he retailer why the seemingly same hat had these differences he advised us that to check what we had bought was the right product and fully suitable i.e upto full safety spec.

They are not. The product we bought are classed only as hard hats and in the lables warns they only offer mininmum impact protection. Which is not what we wanted. We intended to buy helmets that are upto spec. The shop owner when selling us these didnt advise us they were not EPS standerd and also has a sign up stateing this shop does not give refunds and issues credit notes.

We obviously would like to return them get a refund and go buy the hats we need from somewhere who stocks the brand of hat that are EPS standard. Are we allowed/intitled to a refund???

  • Not unless you specifically asked the retailer about the EPS standard and spec at the point of sale.

    Why blame the retailer! By your own admission you were after a particular make, so you knew what you were after, maybe you should have done some proper research first.
  • How about take them back to the original shop and ask nicely if you can swap them for something more suitable?? (...in which case everyone would win)

    It's up to you to check the item you are buying is the one you want. The retailer doesn't have to advise you about every characteristic and spec of the product. Your not entitled to a refund, the best you can hope for is a credit note if you return the items in resellable condition.

    Did you go in and ask their advice for something that met that standard, and/or advised them waht you wanted the helmet for and asked for them to suggest something, or did you just point at one you liked on the shelf and said "this one please". If the latter is closer to the case you can hardly say you've been mis-sold, and they don't have to accept something back simply because you've changed your mind (I know its a bit more than that but that is what it adds up to)...
