The car has done 41,000 miles. I am considering swapping it for a Fiesta ST. I was torn between the two at the time of purchase (I know there's a bit of a difference).

You don't have to reject under SOGA, as in your case "common law" applies

It would seem your chances of success are good but only if porter bought a used car. You could quote the cases
Porter v General guarantee corporation
Farnworth Finance v Attryde (1970)
To the finance company in your letter of rejection note you reject to the finance company not the retailer... but look into it further before writing your letter. One thing you need to find out if Porter bought a new car or used, it could make a difference, but @ only 41000miles you wouldn't expect a new engine needed.

i would have a friendly chat with dealer to come to a compramise like i posted above ask him if he is willing to pay for an engine or recon the original from a supplier of your choice if yes ivor searl is a start there are others out there that recon the original engine and supply recons engines.
and also uphold any of the engines warranty requirements that have to be met to keep the warrenty on it.
i cant see it making any diference in depreciation in value because the engine has been reconned infact if the original is reconed (overhauled) doesnt it prove to a new buyer its been looked after? wouldnt the rx8 be better than the st in handling and performance? plus after recon wouldnt it be back to as new BHP wise after run in?
the dealer sounds like a nice chap and wants to look after you if ringing around places like ivor searl with him in office also and prices are "un-econimical" for him to repair then take the ST off him and hand back the rx8 you win either way.0
